Justice Department failed to inform 911 Commission that Berger stole documents before he testified

If anyone watched the Fox News report titled, "Socks, Papers, Scissors" hosted by David Asman, the conclusion was that the Justice Department was aware that Berger stole and destroyed some of the most sensitive documents in the National Archives - and yet failed to notify the 911 Commission priof to Berger testifying. Berger was sworn in under oath - and gave his testimony to the commission who was unaware of what he did? It wasn't until much later that they were told - after the report was printed and distributed. A commission member said he was shocked to hear that ( I can't remember his name). The Justice Department refuses to comment on its actions, or lack thereof. Can anyone here give me a logical opinion why the Justice Department did nothing, and then only give him 6 months probation and a small fine? I am baffled. Any takers?

I recall reading some fairly in-depth article about that. As I understood it, a Clinton holdover was in charge of the investigation and basically proposed charges and agreed to a favorable plea-bargain before (supposedly) those at higher levels were even aware that there was a case. Once that’s done, you can’t go back and do it over again because of ‘double-jeopardy’...

Potentially high profile, highly sensitive issue, politically volatile...Alberto didn't make the decision to bury this case on his own. Wonder who is in a position to tell Alberto what to do...

Indeed, good reason. ..so why did not Bush dispense with him. . .NO. . .instead, we are pushed on the 'Dem's dime here; and of course, the good reason, stated above is NOT why the Dem's want him out of there.

Coulda, shoulda. . .woulda. . .seems to be a 'now' mantra for President Bush. 'Too late. . .too smart' whatEVER. Bush missed his window for opportunity - again- on this one.

Alberto should fall on his own sword; or get with the program. . .or Bush should push his buttons to make this guy do his job; but canning him now; is just a give away to the heinous Demrats.

I'd also like to know why Berger was never questioned while connect to a truth detector as he agreed to in his agreement.

Amazingly no one in this justice department has ever been interested enough to actually question Berger while connected to a truth detector to find out what he was trying to cover up or what in total he actually stole and destroyed.

Alberto was not AG then. It was the fellow from Missouri John Ashcroft. As he blew the Gorelic (sp) cover to the 911 Commission I do not believe he knew about the Berger caper. I suspect DoJ lifers and Clinton holdovers kept it from him and Bush appointees. They were probably covering their asses.
