The question is was this evidence exculpatory regarding the charges against the agents. I don't believe it is exculpatory in the legal sense. It probably was not admissible under the federal rules of evidence. Further, it appears to be disclosed to the defense based on a reading of the transcript.
Although you imply misconduct by the prosecutor, that is not situation in this case if the evidence was disclosed to the defense. At most it is a point of error for the appeal. The hyperbole by some the agents supporters, as evidenced by your post, only harm the agents case with the public, rather than further their cause.

U.S. Attorney Johnny Sutton's deliberate attempt to mislead the public about Osbaldo Aldrete-Davila's involvement in the transport of a second load of drugs in October 2005.
He should be fired, and prosecuted for malfeasance and obstruction of justice. And the agents pardoned and immediately released!

This is recycled information designed by a particular congressman's office to outrage you.
All this came out when the trial transcripts were discussed and numerous times.
This information was, if you recall, disallowed by the trial judge to come in as evidence, and we all talked about it months ago.
So what is new??????

Better yet, let them post a reasonable appeal bond so that they're free during appeal. Then, when this travesty is eventually overturned, they can sue for back pay, reinstatement, and damages for the violation of their civil rights."
I agree completely and have stated same on FR. A pardon would allow the brain-dead to ignore facts and contend that the agents were really guilty but got a break from a partisan President.
Commute the sentences immediately; release the agents from prison immediately and let the evidence put forth in a new trial exonerate them.
As an aside, can anyone tell me the time lapse between when the smuggler was allegedly shot by the agents and when the bullet was removed?? I have never heard or read a timeline on the matter. If a mule lost a million dollars worth of weed, my investigative experience would lead me to believe he 1) Is lucky to be alive and/or 2) Was probably shot by the supplier/bankroller of the shipment.

The drug smuggler shot by two U.S. Border Patrol agents is planning to sue the federal government for $5 million. Walter Boyaki, the El Paso, Texas-based attorney for Osvaldo Aldrete-Davila, said he will sue the government for wrecking his clients business.
Osvaldo was making $100,000 a month from his export/import business, Boyaki said. Now he is laid up with an embarrassing and incapacitating injury. We are seeking both compensatory damages for lost profits and punitive damages for the indignities Osvaldo has suffered.
Border Patrol Agents Ignacio Ramos and Jose Compean recently began serving prison sentences after being convicted of shooting Aldrete-Davila. The pair encountered the drug smuggler in February of 2005 driving a van containing 743 pounds of marijuana. When the Mexican tried to flee, the agents shot him in the buttocks.
They violated my clients rights, Boyaki said. And the damages are mounting up. Hes got customers whose deliveries have been interrupted. This is trashing his business reputation and endangering future sales. His employees are too frightened to carry on in the climate of violence created by out-of-control border guards. They are demanding raises. His family has had to cancel their European vacation. He has no money to buy gifts for his mistress. Its a real tragedy.

The 5th circuit denied their request to be released pending the outcome of their appeal.Because the prosecution, using false information, vigorously opposed it. The admin. could, and should, direct Sutton to reverse his position on an appeal bond, and join with the defense in a new application.
