I recently found out about a fourth Johnny Sutton victim -- former border patrol agent Gary Brugman. Gary came up against the wrath of Sutton and the prosecutorial arm of the federal government after a very minor confrontation with an illegal alien in January 2001. This led to an 18-month investigation which concluded in Brugman serving 24 months in federal prison for violating the civil rights of an illegal alien.From here.

BROWNSVILLE — A former U.S. Border Patrol agent was acquitted Friday of using excessive force to arrest an illegal immigrant in a retrial of a 2001 case. A federal jury said David Sipe was not guilty of using excessive force against Jose Guevarra on April 5, 2000. The case was first tried in front of Judge Ricardo Hinojosa in McAllen’s U.S. District Court in 2001. At the time, a jury found Sipe guilty after a five-day trial.From here.

It's not a border problem inasmuch as a terroism and enemy within problem.

Sadly I would trust Davila more than the corrupt prosecutor himself... mark my words, it's probably Davila who is blackmailed and threatened by gangs so as to testify thus against Border Agents... lawyers and prosecutors have lots of clients and strings... and many are simply communist activists behind robes.

I find it quite ironic that so many conservatives lambaste Rudy Giuliani for his lack of "moral" fiber. What kind of President countenances this sort of grossly amoral behavior from his golden boys Alberto Gonzales and Johnny Sutton?

It was obvious from W's first few months in office he would overlook most any thing wrong for the sake of his beloved trade agreements. Don't look for a pardon Bush doesn't want to offend business friends. Sad but true. Happened with China and happened here too.

Mexican Drug Dealer to Sue U.S.

The drug smuggler shot by two U.S. Border Patrol agents is planning to sue the federal government for $5 million. Walter Boyaki, the El Paso, Texas-based attorney for Osvaldo Aldrete-Davila, said he will sue the government for wrecking his client’s business.

“Osvaldo was making $100,000 a month from his export/import business,” Boyaki said. “Now he is laid up with an embarrassing and incapacitating injury. We are seeking both compensatory damages for lost profits and punitive damages for the indignities Osvaldo has suffered.”

Border Patrol Agents Ignacio Ramos and Jose Compean recently began serving prison sentences after being convicted of shooting Aldrete-Davila. The pair encountered the drug smuggler in February of 2005 driving a van containing 743 pounds of marijuana. When the Mexican tried to flee, the agents shot him in the buttocks.

“They violated my client’s rights,” Boyaki said. “And the damages are mounting up. He’s got customers whose deliveries have been interrupted. This is trashing his business reputation and endangering future sales. His employees are too frightened to carry on in the climate of violence created by out-of-control border guards. They are demanding raises. His family has had to cancel their European vacation. He has no money to buy gifts for his mistress. It’s a real tragedy.”

You cannot withhold exculpatory evidence from a jury. They have a right to know both the good and the bad "facts" in a case and then to decide for themselves.
It is just like Fitzgerald did in the Libby case, withhold knowledge that Armitage was the actual leaker.
Same with Nifong illegally withholding and conspiring to withhold the DNA report.
Now Sutton. He should be disbarred and sent to jail, in the same cell as the two Border Agents. Now, that would be JUSTICE.

I thought FoxNews had been excerpt-only for quite a while... like, the whole time I've been here.

I am one who prefers excerpts: #1 - so I can go to the link and verify the source, check up on the author, etc.; #2 - I don't like a huge long post at the beginning of the thread.

In fact, a really good post starts with the salient *snips* from an article, in my view.
