Border agents aren't gonna bother to do their jobs with scumbags like sutton around. Why lose your pension or risk going to jail when you can let dopers skate right in with NO CONSEQUENCES WHATSOEVER. Much too easy a choice.

The rogue duo had two easy opportunities to arrest Aldrete-Davila: First, when he attempted to surrender and Compean decided it would be better to smash him with the butt of a shotgun than to put cuffs on him, as it was his duty to do; and then, when the “heroes,” having felled the unarmed, fleeing suspect with a bullet fired into his buttocks, decided to leave him there so they could tend to the more important business of covering up the shooting.

Of course this we know this to be true because drug smugglers hoping to get five million dollars in a suit against the government would never lie.

Ah, yes. You want us to believe he just wanted to "shoot a Mexican", as the OIG-DHS investigator claimed that the BP agents said. He certainly didn't want to arrest the felon and become famous for stopping a major drug smuggler.

How about indicting the BP agents with a law never intended to be applied in these circumstances--you really need to read the Congressional Record testimony promulgating this law. [Here's a headstart, Mr. ex-prosecutor/"journalist": 105th Congress, PL 105-386 A bill to throttle criminal use of guns (S.191)] How about a prosecutor who claims the bullet was matched to Ramos's gun, but the official report states they couldn't even match it to fewer than four firearms makers? How about a sworn affidavit from OIG-DHS stating the same, in direct contradiction to the ballistics report? Isn't that "irrational" in your mind? I call it perjury.

Lovely language!!! Perhaps, Mr. McCarthy, you would have been more pleased if these overzealous prosecutors were successful in bringing home their charge of attempted murder and the BP agents were sentenced to life in prison--or death? Yep... nothing overzealous there! /sarcasm.

The preponderance of the evidence established that Aldrete-Davila was unarmed.

ROFL. The only "evidence" that he had no gun was the word of Aldrete-Davila.

Once Aldrete-Davila was down from Ramos’s shot to the backside, they decided, for a second time, not to grab him so he could face justice for his crimes. ... Instead of arresting the wounded smuggler, they put their guns away and left him behind.

This is simply not credible, is contrary to the testimony of the agents, and is totally unsupported by any facts.

Both agents filed false reports, failing to record the firing of their weapons though they were well aware of regulations requiring that they do so.

Regulations require the supervisor to file a report, a supervisor that was on the scene and chose not to investigate the obvious assault of Compean by Aldrete-Davila.

People is this even logical? Why would he just walk up surrender, not run from being arrested?... And if he did just surrender why would the agent not cuff him but knock him down then shoot him in the butt?, then still not cuff him, but walk away from the guy so he could then escape back to Mexico?...

Is the more logical thing he got shot in the ass running from being arrested?...

Occam razor anyone

but you don’t have to like this case to understand that — barring some demonstration of irrationality (and there has been none) — the factual findings necessary to that verdict merit respect. They are certainly more reliable than hype from those with an ax to grind.

It's good to read an explanation, minus the hype, about this case.

Yes it is, without any doubt. And the lengths our DoJ went to railroad these fine men is just despicable. Johnny Sutton and Alberto Gonzales should both be causalities of this vile offense to the American people.

Yes, the government could have contented itself with lesser charges such as obstruction of justice and false statements, offenses that could probably have been proved without testimony from Aldrete-Davila

But they didn't. They went our of their way to disgrace themselves in order to create scapegoats as a warning to those who oppose the "Norte Americana" crowd and their vast plans for unification, amnesty and mass corruption.

Long drawn out blowhard spewing doesn't make the Government anymore right or any less wrong.

They could end this tomorrow by releasing full unedited transcripts of the trial.

or.. maybe doing that won't make it go away.

Either way, it appears to a great many people that the courts are hiding something.

We already know that DHS flat out lied to Congress on what these men allegedly stated as their intent for the day. Lie once, you'll lie again.

This well written piece somehow neglects to mention what is driving this entire controversy. That two Border Patrol agents, even if they are guilty which is likely, are being prosecuted to the furthest extent of the law for shooting a drug runner while at the same time politicians are doing back flips trying to grant amnesty to 15 million illegals. Yes they are guilty. Yes they deserve jail though 10 years is about 9 too many. But if you cant understand the outrage then youre blind.
