Henry Mark Holzer, writing in Front Page Magazine, makes the very strong case that the New York Times will be indicted for violating the Espionage Act for publication of details helpful to the enemy in the story of wiretapping of internatrional phone calls involving an American end of the conversation.
I wont bother to recapitulate his points because he makes them concisely and you should follow the link.
Should indictments be brought, the resulting prosecution and possible trial (I dont rule out plea agreements once the defendants grasp the prison terms awaiting them and the strength of the case against them) will be a turning point in domestic politics and public opinion.
Liberals will no doubt scream that fascism has arrived in America. I do not rule out a resort to terrorism by the lunatic fringe. The Unabomber sorts. I hope they are few in number and equally isolated.
If that happens, watch for public opinion to turn on the left with fury.
Other outcomes are also possible. A clumsy case could weaken support for necessary anti-terror measures.
But if Holzer is right (and I trust his judgment), we are in for some real fireworks. And Pinch Sulzbergers problems in destroying his family companys value will be the least of his worries.

While one might argue that there should be qualms in considering her a traitor given the circumstances of being trapped in Japan at an inopportune time (and having to make a living there), can a paper honestly devote precious editorial space to honor someone who propagandized on behalf of the enemy during war?
If one is talking about her post World War 2 career she did nothing exceptional to justify praise by the Times. She did not work with the poor, help rehabilitate wounded vets, work in the USO, or other honorable endeavors to redeem her name. A redemption that only the New York Times sees fit to propose.
What next in a few years? An editorial calling for a pardon for John Walker Lindh, the American Taliban?

We discovered that she was not indicted because of a political failure of will by the Nixon administration.
So I guess the same could be said for Jean Francois Kerry... and his meetings in Paris with the Viet Cong.

My grandpappy was so right when he said of newspapers (and this applies to the internet too), "When they start talking in the future tense, you can stop reading."
Bush didn't have the cojones to go after the NYT before, and he doesn't now.

A conservative version of the tooth fairy con. Do not believe that the DOJ will leave an indictment under your pillow, just because the law says they can--or should.
There is not now, and never will be, a department of justice that will have the moral courage to indict the NYT editors, no matter what the provocation or the law.
Oh, and there's no Santa Claus either folks.
