A woman who accused her doctor of molesting her and having his identical twin impersonate him to assault her must pay the doctor $2.8 million because she fabricated the allegations, a judge ruled.
Judge Katherine Stolz dismissed Perla Saldivar's lawsuit against her doctor, Dr. Dennis Momah, and his twin, Dr. Charles Momah, a gynecologist, saying her allegations were inconsistent with evidence.
"The contradictions and inconsistencies in Ms. Saldivar's testimony were some of the most pronounced this court has ever seen," Stolz wrote Wednesday.
The ruling is the latest in a saga involving the Momahs. Charles Momah was sentenced in November to 20 years in prison for sexual crimes against female patients. Patients said he unnecessarily prescribed pain medication, performed unnecessary procedures and fondled them. He has appealed.
Dennis Momah has not been charged with any crimes, but former patients have claimed he sometimes posed as his brother to abuse them.
The judge also fined Saldivar's lawyer $300,000. Stolz called Harish Bharti of Seattle a knowing participant in the falsehoods against the Momah brothers, and also ordered him to post her decision on his Web site for at least a year or as long as it contains reference to the brothers. He said he will appeal.
Albert Saldivar said he and his wife would also appeal the ruling, calling it "an unjust blunder that flies right into the face of public policy of protecting victims of sexual crimes, and sends the wrong message _ that it pays to be a sexual predator."
She must have seen that movie "Dead Ringers" with Jeremy Irons as creepy twin-brother gynos.

it sounds like this woman's story is consistent with the Dr's histories. Is she just jumping on the band wagon?

Seems so. She probably had a civil suit in mind.
I have seen too many lawyers who think their law license (aka meal ticket) is a free pass to fabricate claims to obtain money via intimidation.
When the suit goes down in flames they go "shocked shocked shocked" and cry crocodile tears.
The first line of responsiblity in the civil courts is the lawyer who does not take the case or is just plain honest with the client and tells them the facts of life. Instead we have lawyers who will file any suit because it is a "slow week".
This is what you get when nationally there is 1 first year law school seat for each application to law school. Seriously, ANYBODY can get into "a" law school today. not a joke. a fact.

When I saw "$2.8M for False Charge", my first thought was "that is some fee for a boob job."
That is true. There are way too many law schools. But there are far too many who want to go to law school because they think they'll become rich, rich, rich.
Only ambulance chasers and corporate types are truly rich lawyers today. Most are solidly middle class or struggling.
Even though anyone can get in, making it through and especially, passing the bar exam, are tougher. That's why the bar passage rate is dropping and there is such a hue and a cry from some quarters about the tests being culturally unfair and efforts to lower the passing scores in some states.
