Feingold said this stuff last night, but President Bush did a good job of smackin' down the Dems at his news conference today, especially on Iraq and Iran.

He also got in a good swipe across Helen Thomas' sagging jowls, LOL!

He was pretty feisty. :)

Does FISA apply in this instance, and does it supercede a President's powers to protect American citizens from harm during a time of war? Nobody in Congress seems to want to answer those questions.

Just to make matters ever slightly more complex, there is a provision of FISA that permits wiretapping without warrants, PERIOD. That is, no 72 hour wait, no warrant, ever, and legal under FISA.

The phrases that this determination turns on are "foreign intelligence purposes" and "foreign power." See 50 USC 1802.
