Let me clarify: carrying money is not in itself an act of commerce; commerce involves the exchange of money for goods and services. But one would carry money abroad only with the intent of procuring goods and services in foreign Nations and thus engaging in commerce with foreigners. We have yet to learn what sort of goods and services he intended to exchange for that money while in Pakistan. But practically nobody would pack $80,000 for a trip to Pakistan only to return to America with the same money. We have banks for the safekeeping of money. Requiring the declaration of such large amounts of cash leaving the country, therefore, amounts to a necessary and proper extension of the Power of the Congress to regulate commerce with foreign Nations.

Section 371 of the Patriot Act makes it a crime to transport in excess of $10k out of the country in luggage. The punishment is 5 years plus forfieture of the cash.

The intended use of the money is not a factor. Taking $80K out of the country in luggage is against the law, period.
