Sperm donor to pay child support

A SWEDISH man who donated his sperm to a lesbian couple must pay child support for the three children he fathered, Sweden's Supreme Court ruled today.

The man, now 39, donated his sperm to the couple in the early 1990s. Three sons were born during the years 1992-1996, according to Swedish news agency TT which reported the ruling. The man told the court that he and the women had agreed that he would play no role in the boys' child rearing and that the two women would be their parents.

Nonetheless, the man signed a document confirming that he was the biological father of the children.

Shortly after he signed the document, the two women separated and the biological mother demanded that the man pay child support.

The man took the case to court, but lost in the district and appeals courts.

The Supreme Court upheld those rulings today, saying that as the biological father he is required to pay for the children's upbringing.

A few years ago in Massachusetts, a man found out through a DNA test that he was not the father of the child he had been paying child support to for years. The poor sap had believed the child's mother when she said that he was the daddy. After learning that he had been duped, the guy tried to get his child support obligation terminated. The Court said no - still gotta pay.

I still remember the line on a Law and Order show, "Child support is the right of the child, not the parent." Though parents can sign over other rights of their child, they cannot deny him child support.

Perhaps our Supreme Court will adopt this ruling?
If he were the biological father of a child subsequently adopted by a lesbian couple, would he still be liable?

Sorry, I have to disagree.

I don't think donating sperm to a lesbian couple falls in the "good deed" category.

More like enabling freaks to impose their perversion on the next generation.

If he'd donated to a hetero couple unable to conceive, that would be a different story.

Not only should this guy pay child support, but he should pay for the therapy these kids are going to need. In the welfare state of Sweden, he should reimburse the state for any welfare they are sure to collect for the rest of their lives.

I once dated an evil, manipulative bi**c, who it later turned out, was catting around with a number of guys. She just liked the fact that I treated her well, and didn't really ask for anything in return. When I found out what she was doing "on the side," she was really quite angry when I told her that I was going to have nothing to do with her, ever again.

A few months later I got a call from her. She told me that she was pregnant, and that I would have to marry her, otherwise she was going to file a paternaty suit against me. I had to remind her that we had never had sex. I never did find out if she were really pregnant or not. If she was, I feel terribly sorry for any children she had. Either way, I feel sorry for any guy or guys she managed to ensnare!

YEs - BUT....

This also shows just how corrupt those who practice homosexuality are - they just wanted his sperm. Now they want his money, despite their agreement that he was simply the "sperm donor".

But I also agree that he should have known better. Unfortunately, the same thing could happen here in the states, even if it were a single woman.....

I know a few lesbian couples that have had kids... every last one of em, the "mother" stays home and is considered single by the state and gets tons of freebies for her and her kid from the social welfare programs....

I have been approached by lesbian couples to donate the sperm for them to have children... I have politely turned them down cold. Heather doesn't need 2 mommies.. and heaven help any boy that would be raised in such an environment.

The guy got what he deserved. Putting a child in a perverted relationship.

Wait until it happens with all those college students here in the U. S. that made money at the sperm bank...they can just consider it an 18 year loan.

I'm still wrestling with the implications. Is this good news? Meaning, lesbians will be unable to bear children because no guy in his right mind will be a donor?

I agree with the rest of you however. The poor children conceived won't have to hear, when they ask their Mom, "Who's my Dad?" that their father was a turkey baster.

Wait until this decision is upheld in an American court. Thousands of heterosexual couples with infertility conditions will find having a child even more difficult when sperm donors stop donating over the fear of being held financially responsible.

Just a Minute, I'm assuming he didn't place the sperm directly into the "woman" because of her Disorder, Therefor the doctor actually impregnated the "Woman" and the Doctor should pay the support.
In any event this surrogate man should be removed from the Gene Pool.

It is an abuse of children's rights. A child has the right to have its parents in its life. Children are not property that can be bought, sold, or donated.

I'm speaking of how things should be, not how they are: children should not be bought, sold or donated. But at least in the case of adoption people are trying to find a way to resolve a situation in which children cannot be raised by their parents. In the case of gay marriage and sperm donors they are deliberately creating a situation in which children are not being raised by their parents.

I think almost all of us agree that homosexual couples is not in the best interest of the child(ren). I am considering the implications this ruling will have on heterosexual couples who face infertility problems.

My husband and I have faced that problem for our 12 year marriage. Unless someone sells and we buy a child (private adoption) or the components are donated for us to conceive on our own (infertility treatments) we would be childless.

I am thankful that there are people in this country willing to donate sperm/eggs in order to help people to have a child. I wonder how much that would change if our courts adopted this same ruling. It isn't like our USSC has never based a decision on the laws of another nation.

I believe sperm banks keep donors confidential for exactly this reason. If they didn't every donor would have to pay child support and there wouldn't be any donors anymore. These people made a private arrangement which meant that the mother knew who the donor was. If she had used a sperm bank she would have been out of luck in trying to collect child support.

Still, I guess it is only a matter of time before some mother hires a private investigator to track down her anonymous donor and take him to court for child support. When that happens in vitro fertilization will become a thing of the past.
