The President should nominate anyone he chooses, but he should also make a recess-appointment of Judge Bork, while they're waiting on the Senate to read the Constitution.

Bork's 78. Assuming that he replaces Rehnquist then that would make him the second oldest justice on the court. Why waste an appointment on someone who won't be on the court for any length of time?

I'm all for a recess appointment for someone like Bork, but wouldn't Bush have to wait for an actual recess before making a recess appointment?

If Spector and Hagel vote against the nuclear option Harry Reid, Schumer, and Ted Kennedy will have all the power to approve what judges are acceptable.

From what I hear from D.C., that IS the deal they are trying to make: two nominees would not get through -- probably Saad and Myers. Then, the Senate would actually compile a list of "acceptable" nominees for the President to choose from. And here's the kicker - they could still filibuster to their hearts content, even from the 'acceptable' list.

And to make it worse: they would vote FOR cloture -- thus letting Owen get an up or down vote and NOT triggering the need for the constitutional option.

That's not true at all. There's been maybe 10 Supreme Court recess appointments over the years. Earl Warren, William Brennan, and Potter Stewart are the more recent ones.

I had NO idea you could do that. Do they just serve until the end of the term or the president's term?

They would serve until the end of the following Congress if not confirmed before that time. Historically, they've mostly been confirmed before the temp term expires. Here's some good info.
