WHEN U.S. Supreme Court Justice Antonin Scalia (above) spoke Tuesday night at NYU's Vanderbilt Hall, "The room was packed with some 300 students and there were many protesters outside because of Scalia's vitriolic dissent last year in the case that overturned the Texas law against gay sex," our source reports. "One gay student asked whether government had any business enacting and enforcing laws against consensual sodomy. Following Scalia's answer, the student asked a follow-up: 'Do you sodomize your wife?' The audience was shocked, especially since Mrs. Scalia [Maureen] was in attendance. The justice replied that the question was unworthy of an answer."

Justices Thomas and Scalia have both expressed their opinions that sodomy laws were stupid. Not every law that is stupid is unconstitutional. Surely that is a respectable position. You may disagree with it, but to throw that verbal pie in the face is just awful.

These morons just don't get these simple concepts regarding our Constitution:

(1) the Bill of Rights does not apply to the states (unfortunately, after 80 years of the federal courts perpetuating the lie that the BOR was incorporated against the states by the 14th Amendment...only Justice Thomas ever hints at reversing the incorporation lie)

(2) substantive due process is a legal fiction

(3) it matters not if Scalia visited bathhouses every night after he left got off work...it would matter not whether every American thought criminalizing homosexuality is bad policy or unnecessary...none of that would make it unconstitutional

That's exactly what I was thinking. Scalia has never said that anti-sodomy laws are logical, advisable, desirable, or anything else beyond just constitutional. It's part of elective government--if there's a stupid law, urge your elected rep to deal with it. If they won't, don't vote for them. Even beyond that, if the community thinks that enforcing said law is a waste of time and resources, there's a good chance local law enforcement and DA officers will leave it alone.

Eric Berndt is a typical privileged, obnoxiuous snotnose who imagines he is somehow on a par with a U.S. Supreme Court Justice. When Bernt asked his discourteous and insulting question, monitors in the room turned off his microphone. Someone should turn off his sinuous path to a law degree. Justice Scalia has been forthright and ingenuous in making himself available to law students as no Justice before him. Berndt's immature rudeness will inevitably land his future clients in hot water, whether they be on trial for murder or tex evasion. Berndt's lapse of good manners will precede him throughout his career.
