Law won't let state learn outcome of attempts
At least four people on the FBI terrorism watch list have tried to buy guns legally in Colorado since the Sept. 11 terrorist attacks, the Colorado Bureau of Investigation said Tuesday.
The FBI was notified immediately when the CBI's instant background checks for would-be gun purchasers found matches with names on the list, CBI deputy director Bob Armstrong said.
But the four weren't taken into custody because there were no warrants out for their arrest, Armstrong said.
A person on the list isn't automatically disqualified from buying a gun. Only certain factors can prevent a gun purchase, such as being a felon, an illegal immigrant or someone deemed "mentally defective."
Armstrong could not say if the four people passed their background checks and were permitted to buy weapons, partially because there might be an ongoing investigation of them. In addition, state and federal laws require records on gun purchasers to be destroyed within 24 hours. As a result, he can't look them up.
The law requiring quick destruction of gun-check records passed because gun owners feared that they would amount to a registry of firearms owners.
There may have been more than four people on the terrorism watch list who tried to buy guns in Colorado, Armstrong said. He said he simply remembers at least four.
A new report by the Government Accountability Office found that in nine months last year, 47 people on the watch list legally bought guns in the United States.
That report seemed to support law enforcement concerns that people with terrorism links could legally buy an assault weapon and then use it in an attack.
Sen. Frank Lautenberg, D-N.J., who requested the GAO study, said he plans to introduce legislation that would require the Justice Department to keep records of gun purchases by terror suspects for 10 years.
"When the Justice Department destroys these records in 24 hours, they are essentially aiding and abetting terrorist organizations," Lautenberg said. "It's time to end this nonsensical and dangerous policy."
Even though the records of CBI's instant background checks are destroyed, the FBI is notified when a terrorism suspect tries to buy a firearm, and keeps a record of it in its intelligence file on the person, Denver FBI spokesman Carl Schlaff said.
"If we plan to arrest him, we might want to know if he bought a stockpile of guns," Schlaff said.
Schlaff said there's no cause to deny someone a gun just because he or she is on the watch list. Some people are on the list simply because the FBI wants to interview them about someone else who may have a connection to terrorism. "You're innocent until proven guilty," he said.
Sometimes the watch list will warn local law enforcement to contact the FBI about a person on the list immediately. In other cases, it says only to be aware that the FBI is interested in the person, Schlaff said.
Federal agencies also use watch lists for drug cases and other crimes, Schlaff said.
For example, a sheriff near the Mexican border might pull over a driver who shows up on the Drug Enforcement Administration watch list. The officer might be told that the suspect typically carries his smuggled drugs in the gas tank, and the officer could call for a dog to check, Schlaff said.
Government was not granted the power to infringe on the right of the people to keep and bear arms, so there are no "gun laws". To make that perfectly clear to would be tyrants (Whigs/Republicans and Democrats), the Second Amendment was added to the Constitution.
Cruel and unusual punishment, such as ex-cons alleged loss of civil rights, is specifically prohibited under the Eighth Amendment.
Databases and background checks were not among the powers granted to gov either. To make that perfectly clear to the aforementioned tyrants, the Fourth and Fifth Amendments were added to the Constitution.
Legislating and prosecuting Pre-crime, thought-crime, "terrorists", and "gangs" was not granted to gov. The First, Fourth, Fifth, and Ninth Amendments cover this.
Doesn't anyone read the Constitution, or have any regard for the rule of law nowadays? Of the BOR, the only Amendment the gov doesn't violate on a daily basis is the Third (quartering of troups).

I wouldn't worry too much. We have all heard about innocent people with the same name as a suspected terrorist being prevented from flying. Probably the same thing here.
Certainly not the Supreme Court. They rule according to what OTHER NATIONS are doing.
Since the liberals answer to everything is more laws, why don't we just pass a law requiring terrorists to register with local law enforcement like sex offenders? (sarc)
