Scalia "thinks there are no such thing as unenumerated rights in the Constitution which fundamentally alters the way in which you read the liberty clause of the 14th Amendment and a whole range of other things," the Delaware Democrat complained,

Can someone please explain what Biden is talking about here?

The 14th amendment arguments as liberals see it, I believe are based on the Ninth Amendment: The enumeration of the Constitution, of certain rights , shall not be construed to deny or disparage others retained by the people"Keep in mind that these rights must be acquired by legislative process and not activist judges, thus Scalia is much closer to Constitutional reality than whats his face.

Jesse Helms said it would be foolish to give up the filibuster if all conservatives are going to get are Republican judicial appointments in the vein of John Paul Stevens, Sandra Day O'Connor, Anthony Kennedy, and David Souter. None of those four is worth a plug nickel in my book.

Let's start with the fact that both sides know that it is un Constitutional to filibuster a judicial nominee.

And you base this fact on what?

All persons born or naturalized in the United States

This should have been written:

All persons legally born . . .in the United States...

Of course, the fact that the Constitution is silent as to parking tickets and meat regulation makes them unconstitutional too.

Gee, does that mean I can tell my daughter that she cannot get a tattoo or multiple body piercings because that would be unconstitutional?

Constitutional "rights" that are NOT in the U.S. Constitution. Biden wants judges who make up Constitutional rights from their feeble minds., ie abortion rights, animal right, ET rights, anything else you can think of ect...

He wants activist judges who can rule anything Constitutional.

Hey Joe Biden! You're the dumbest man in the Senate.
Additional 'Constitutional rights' are done by a legislative process, not by a judicial process. You dumbass.

That is not surprising.

The surprise would be if he supported him.

I base it on the fact that...

Ah, it's unconstitutional because you say it is. Thanks for clearing that up.
