January 27, 2005, Introduced by Reps. Sheen, Jones, Hoogendyk, Nofs, Drolet, Acciavatti, Gosselin, Brandenburg, Pastor, Stakoe, Marleau, Elsenheimer, Shaffer, Hildenbrand, Schuitmaker, Pavlov, Caswell, Brown, Gleason and Robertson and referred to the Committee on Judiciary.

     A bill to amend 1927 PA 372, entitled

 

"An act to regulate and license the selling, purchasing,

possessing, and carrying of certain firearms and gas ejecting

devices; to prohibit the buying, selling, or carrying of certain

firearms and gas ejecting devices without a license or other

authorization; to provide for the forfeiture of firearms under

certain circumstances; to provide for penalties and remedies; to

provide immunity from civil liability under certain circumstances;

to prescribe the powers and duties of certain state and local

agencies; to prohibit certain conduct against individuals who apply

for or receive a license to carry a concealed pistol; to make

appropriations; to prescribe certain conditions for the

appropriations; and to repeal all acts and parts of acts

inconsistent with this act,"

 

by amending section 5l (MCL 28.425l), as amended by 2002 PA 719.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 5l. (1) A license to carry a concealed pistol issued

 

before July 1, 2003 is valid for 3 years and a license to carry a

 

concealed pistol issued on or after July 1, 2003 is valid for 5

 

years.  A  Except as provided in subsections (3) and (4), a renewal

 

of a license under section 5b shall be issued in the same manner as

 

an original license issued under section 5b.

 

     (2) The educational requirements under section 5b(7)(c) are

 

waived for an applicant who is a retired police officer or retired

 

law enforcement officer.

 

     (3) The educational requirements under section 5b(7)(c) for an

 

applicant who is applying for a renewal of a license under this act

 

are waived except that the applicant shall certify that he or she

 

has completed at least 3 hours' review of the training described

 

under section 5b(7)(c) and has had at least 1 hour of firing range

 

time in the 6 months immediately preceding the subsequent

 

application.

 

     (4) The fingerprinting requirements under section 5b are

 

waived for an applicant who is applying for a renewal of a license

 

under this act.

Basicaly, this gets rid of the fingerprint requirements for those are renewing their conceal carry license. This is a good bill.

Good. The fewer restrictions, the more people will carry. The more that carry...well, you know.

Seriously, one objection I have to relocating to the UP is your state's insistence on knowing what kind of hardware I have and declaring it when I take up residence. I may be from the socialist state of Minnesota, but that is none of MI's damn business!

Unfortunatly, it's been that way since the 1920's for pistols. It's the last hurdle to take out (outside of Class III).

When I bought my pistol, I had to first get a "purchase permit" from the local PD(Sheriff at my old address since my township had no PD). They are free at some places, cost at others.

Then I had to take it back for (cough) registration, I mean "Safety Inspection" where I get a "Green Card".

The "Safety Inspection" consists of the undersheriff and the deputies at the station cops looking at how 'cool' the gun is. "Whoa, this is a nice one!"

Folks I know in the UP probably don't do too much in the line of safety inspection compliance.

I seriously hope they get rid of the oppressive gun laws (I suspect the Detroit riots at the root of it all). Looks like you're headed down the right track. Get it all settled and I'll start lookin' at land again!

Actually blame the Ku Klux Klan. They lobbied for all the laws in the 20's when one of those those "uppity you-know-whats" defended himself from those Klucksters. Dr. Ossian Sweet, a black man, committed the "crime" of moving into a white area of Detroit. A mob stoned his place, and Dr Sweet's brother shot one of them in self defense.

At their heart, all gun control laws are inherently racist. The first ones were passed specifically to deny blacks and other minorities the means to defend themselves from the likes of the Klan.

Remember the Feds trying to shake down Cabrini Greens residents because they lived in Federal housing?

Yep. He tried to deprive them of their 2nd, 4th, and 5th Amendment rights because they lived in 'public housing'.

Mayor Daley was right there with him.
