HALIFAX - The Supreme Court of Canada is being asked to hear arguments on whether the word "kemosabe" is racist to native people.

The request comes from the Nova Scotia Human Rights Commission, which is dealing with a grievance dating back to 1999. ''We think it's time to … have some ground rules so people know what's permissible and what isn't.' – human rights lawyer

Dorothy Kateri Moore, a Mi'kmaq woman working at a sports store in Sydney, N.S., had complained that her boss, Trevor Miller, referred to her and other workers as "kemosabe" – the term used by the 1950s TV character Tonto, the Lone Ranger's sidekick, to describe the masked cowboy.

Moore said Miller told her the word meant "friend." But she claimed it was a racial slur and that its repeated use led to a poisoned work environment.

Last February, a human rights board of inquiry ruled Moore was not discriminated against because she hadn't shown she was offended by the word, nor did she ask her boss to stop using it.

The Nova Scotia Court of Appeal upheld that ruling in October, saying Moore had not shown the term was "notoriously offensive."

For the first time in its 37-year history, the commission has asked the Supreme Court of Canada to appeal a decision of the province's Court of Appeal.

Commission lawyers say they will argue employees were afraid to speak up to their employer and they want the Supreme Court to draw the line on what language is acceptable in the workplace.

"The idea that there are some words that are notoriously offensive and some that aren't, and the burden on the employee shifts depending on that, really creates a lot of confusion in the workplace," said commission lawyer Michael Wood. "We think it's time to clarify that and have some ground rules so people know what's permissible and what isn't."

During the inquiry hearings, several members of the Mi'kmaq community testified that "kemosabe" was a racial slur, although others said they were not offended by it.

The board of inquiry spent one day looking at old Lone Ranger shows, eventually concluding that the term was never used in a derogatory way and that Tonto and the Lone Ranger treated each other with respect.

The Supreme Court has yet to decide if it will hear the appeal.

My $.02: Any word can be used in a way which creates a hostile work environment. If I walk past a subordinate at work, and say, "Hi, Catnip" in a menacing tone of voice, Catnip can become derogatory.

If Timmy walks past Louie, who happens to be black, and says, "Merry Kwaanza" every day in the right tone of voice, eventually Louie can darn well start to feel as if Timmy is pointing out daily that Louie is black. And, thus, he can feel racially discriminated by Timmy. Especially if he doesn't celebrate Kwaanza.

The standard is "be nice." If Kateri Moore doesn't like being called Kemosabe, she can tell Mr Miller that being given a nickname which highlights her race makes her feel uncomfortable. But apparently what she expects is to be able to neurotically not speak up for herself at all, until her rage explodes and she runs to a lawyer.

Lawsuits are for protecting victims, not enabling deep neurotics. What is absurd is the attempt to include "Kemosabe" in a list of words which are inherently offensive, and punish Mr Miller for not recognizing this heretofore unestablished fact.

Didn't it translate to "soggy shirt"? Now for the 64 K question, WHO CARES. There is way too many improant issues to be taken care of down here, than worry about what some stupid court in Canada has to say.

A couple of years ago I was in a store and thought I saw an old friend of mine. I moved down the aisle and called to him, "Clarence?". I got closer and called again, "Hey Clarence!" I was about ten feet away when the guy turned around and I saw it wasn't my friend.
"I'm sorry", I said. "From the back you looked just like someone I know."
In a raised voice he a replied belligerantly, "Why, because I'm BLACK?"

People were looking at us and I was just stunned. I stood there for a second, which seemed like a minute, not knowing what to say. I shook my head and just said, "excuse me" and turned away.

I've thought of the moment many times since then and replayed what I should have done if I were of quicker wit. But, since my friend is a 6'5" black guy I wouldn't have made the mistake were this guy a short red head. The sad point of the story is that this is the world Jesse Jackson and the liberals have thrust upon black people.

The painful memory is how instantly irate this guy was over a simple incident of being mistaken for someone else... by someone who wanted to shake his hand and say, "good to see you, my old friend."

Makes no sense. ......considering "Kemosabe" was the the term Tonto used to describe the Lone Ranger, not the other way around.

Thanks for the link. It is just as I thought. It was "Tonto" the Indians reference to a White Man, the Lone Ranger.

The link shows that the word may reference "One who peeks" or "Scout".

So I chalk this up to political correctness and liberal courts gone awry.

The radio show of the Lone Ranger long predated The TV show with Clayton Moore. The original Lone Ranger was played on the radio show by a guy named Brace Beamer. (sp?)
