If it's true, then surely Berg mentioned it to some of his acquaintances. All it takes is one who wants to sell his story to the Enquirer.
Unfortunately, I don't think you can subpoena anything unless you first sue someone. But here's a thought: A Freedom of Information Request might get at government records that Moore would have to file in order to keep Berg on his payroll.
