An armed man who tried to carjack a motorist at a DeKalb County gas station Sunday was killed when the motorist shot at him, police said.
DeKalb police said the would-be carjacker, Banarrek Von Clayton, 28, was shot in the leg and later died at Grady Memorial Hospital.
The motorist, Brian Dean, 24, told police he was at a gas station in the 4300 block of Glenwood Road at about 3 a.m. when Clayton approached him and threatened him with a gun.
Dean then took out his gun and shot Clayton in the leg, said Sgt. Willie Durrett.
Clayton was able to drive off in Dean's 1970 Cadillac Deville but crashed the car into a utility pole a few feet away, Durrett said.
Police did not charge Dean in the shooting.

I'm not on the side of the carjacker in anyway.... but to be honest.... someone wants to steal my 1970 Cadillac.... well I'm not sure I'd kill him for it. (I don't own a 1970 Cadillac by the way) I mean what's the thing worth $200?

First of all, that could be a bad-ass reconditioned pimp-mobile and classic car that the owner possibly spent a lot of time and effort to maintain.
Second, when someone threatens you with a gun, they are threatening your life. You do not know if they are complete wack jobs who will kill you anyway, even if you give up the wheels.
It's not that...it's that he's got a gun pointed at you, and may decide to kill you for kicks. The car really isn't the issue.

A 34 year old car in mint condition can be worth many thousands of dollars.

One of the first things my grandpappy taught me about gunfights is that you don't wait to see if the other guy is gonna shoot you. If he is brandishing a gun he is considered a target, period.
This guy goes prepared. Kudos to the right to carry law.

Maybe it is restored and worth a lot of money and worth even more to the owner, due to the time invested in the restoration.
I don't disagree with that. But the story doesn't say that's what happened. IN FACT... I'd guess that the guy didn't pull the gun out while the carjacker had the "drop on him". I'd guess that he shot him after the car exchange had been made.

Depends on the condition. I've been offered $5,000.00 for my '78 Pontiac. It is only 90% restored. I would shoot anyone who tried waving a gun at to steal my car.... or my lunch money.
It is not the value of the car, it is the principle of protecting what's your and you been working for.
What did the car-jacker say after being shot? "Well, you shot me. Probably got my femoral artery -- 'cause I'm bleeding like a Son-of-a-B****, but I'm still taking your car. I know you still have a gun, but don't try to stop me from getting in your car and driving away. And, yeah, I still have my gun, but I'm not going to return fire -- that might escalate things. I'm getting light-headed here, so I'll just drive off now."
If someone threatens me with a gun, I am going to do anything I can in that moment to take them out of the gene pool. It is your responsibility as a citizen to fight back against predators. Someone else might not be able to defend themselves against this sort of scum, and if they are willing to use a gun to take a car, they will use a gun to take whatever they want, and that might cost an innocent person their life at some point. Evil only survives if we let it.

It would be interesting to know if the carjacker got shot before or after he got in the car and was leaving with it.

Which explains why you'd take it to a seedy gas station at 3 a.m. Given the age of the shooter, I doubt he's the original owner. My guess is that it was a cheap college ride that was still running. Until now.
My only thoughts would be how to get the barral of my firearm lined up with his center of mass before he squeezes one off.
True but...how can you be sure the carjacker would not kill you ANYWAY since you saw who he was and could describe him? Are you willing to take that chance? I think the victim of the carjacker did the right thing because he is ALIVE. He defended himself and won. That's one in the column for the good guy.
Yeah.... I know... everybody here is a walking talking Dirty Harry. But you know... I think very few people will pull out a gun when a carjacker has "the drop on you". I don't think this guy did either. I think he pulled the gun and shot him when it was safe to do so.
If this had happened in New York City instead of DeKalb County, Georgia, the owner would be locked up in Rikers Island for murder.
You are assuming that the Caddy has seen 34 years of road use and neglect. How much would it be worth if it was a mint condition restoration project? $20-$30K at least, I would say.
You are focusing on the property and not the crime. It is not the value of what is stolen, the creep decided that it would be okay to pull a gun on someone and take what they had. If you attempt an armed robbery on a bank and only get away with $200, is it less of a crime than if you get away with $20,000? Should the police be prohibited from using deadly force to stop an armed robber just because he didn't steal much?
Our martial arts instructor trained us to take a shot at the pelvic girdle of an attacker, if possible. It's an immediate takedown, delivers massive shock and trauma, and it's an area that's not often protected by body armor. It's basically a low center-of-mass shot.
I could be wrong... but I'd guess this guy shot the carjacker while he was leaving. (when it was safe to pull the gun out without getting shot at). And he shot him becuase he was torqued about having his car stolen. I'll defend his right to do that. I'm just saying... I wouldn't.
And you might remove him from the gene pool even if you don't kill him.

The only good car-jacker is a dead car-jacker.
Doesn't matter, or at least it wouldn't in Texas. Use of deadly force to prvent a theft in progress is perfectly acceptable. But the story doesn't indicate that that the victim shot the perp as the perp was making off with the car, the shot may just as well have occured as the victim was being dragged from the vehicle. In any event the story does indicate that the victim pulled out his gun and shot the perp AFTER the perp threatened him with a gun. But you know what? I don't care, the still standing score on this one was:
Good Guys 1
Bad Guys 0
And that's good enough for me.

The story says the victim pulled his gun AFTER being threated with a gun. That's all it takes to make it justifiable homicide. If the perp didn't want to get shot, he should't have been jacking the victim's Caddy. A dangerous practice indeed.
I've been in two shoot/no-shoot situations so far in my life once I got my weapon out before he did the 2nd time the badguy got distracted and I was able to arm myself and discourage him. (looking down the barrel of a shotgun will tend to do that to would be attackers) So far I've been able to keep my property/protect my family and not shoot the badguy.
Both times the police told me I was very lucky, I consider it a bit of luck and a lot of preparation.
I believe G Liddy said something similar about stormtroopers.
After reading this story, I was more concerned about the 1970 Cadillac then the dead theif.
I really hope these Darwin Award winning theives understand this. That I'm more concerned about the victirm and his property than some lowlife terrorist.
