(South Dakota) State House passes bill outlawing abortion

The South Dakota state House has passed a bill that would outlaw abortion and challenge the landmark Roe vs. Wade decision.

Approved 54 to 14 after two hours of emotional debate Tuesday, the bill would make the practice of abortion a felony carrying a five-year sentence.

A public-interest law firm that worked with lawmakers to draft the bill says it is designed to have the U.S. Supreme Court reconsider its 1973 Roe decision, which struck down state laws banning abortion.

"This is new and unique legislation that has never been considered by the Supreme Court," said Richard Thompson, president and chief counsel of the Thomas More Law Center in Ann Arbor, Mich. " … While we cannot predict the future, we do know that this legislation establishes significant facts that the courts will not be able to ignore."

House Bill 1191, sponsored by Rep. Matt McCaulley, says the legislature determined that based on the best scientific and medical evidence, life begins at fertilization and that South Dakota's Bill of Rights applies equally to born and unborn human beings.

The bill also finds abortions impose significant risks to the health and life of the pregnant mother, including significant risk of suicide, depression and other post- traumatic disorders.

"Abortion is an important moral issue that transcends party lines," McCaulley said. "Protecting unborn human life is something the vast majority of South Dakota residents support, and Democrats and Republicans joined together and passed a bill that will protect unborn human life in our state. We are ready to fight for the right to life, as opposed to waiting for it."

The bill now goes to the Senate where support continues to be strong, the More Center said, noting South Dakota Gov. Mike Rounds is pro-life.

The bill requires physicians to make every effort to preserve the life of both the mother and her unborn child.

Committee testimony on the bill included women who recounted their personal grief, severe depression and thoughts of suicide after having an abortions. Planned Parenthood representatives strongly opposed the measure, but the panel passed it 11-2, sending it to the House for Tuesday's vote.

God bless South Dakota. Keep forcing the courts to strike it down, and make sure the judges see the 4D ultrasound images every step of the way. The judges owe those children sentenced to death the courtesy of at least looking them in the eye before their execution.

So that means that it does not outlaw abortions, just unnecessary ones.

This is extraordinarily poor timing. First of all, an injunction from a Federal court will follow almost immediately. Not one, I say again, not one innocent life will be saved. Secondly, at a time when conservatives and Republicans are finally starting to gain some ground on social issues (e.g. homosexual marriage, Pledge of Allegiance/Boy Scout banning and TV nudity and violence), this comes along so that the Democrats can show the women of America how "under threat" their "reproductive"/abortion rights are. Ideologically wonderful, but in practical terms: STUPID, STUPID, STUPID!

In case anyone is interested in the teaching of the Catholic Church on this matter: It is the duty of every legislature to pass a law outlawing abortion, and imposing a penalty for performing abortions, one that is commensurate with the crime of homicide. It is also the duty of every governor and D.A. to enforce such laws. It is also the duty of every police officer to behave in a manner that acknowledges that people are murdered in abortion clinics--i.e., it is a crime for a governor, judge, a prosecutor, or a police officer to arrest or impede or frustrate efforts by citizens to protect innocent life that is in peril.

All decisions by any court, and all acts by any legislature, which have as their purpose marking out some segment of the human population as not entitled to protection from homicide, are null. The duties of all public officials, whether legislators, executives, or judges, are unaffected by any law, court order, or judicial decision, which purports to authorize the commission of homicide.

The fact that no bishop in the United States has said anything resembling the above since April 1973 does not alter the fact that this is the moral law.

Realistically, if this passes, the pro-infanticide crowd will have a lawsuit barring implementation signed by one of their per judges before the ink is dry.

Anything to get this issue into the newspapers and before the ignorant. 4D, 4D, 4D. If our side can just get "4D" and "google" into the same newspaper article, it will be a huge victory.

I'm very pleased to hear that this passed! It's a good message to send that there are still states that are poised to outlaw such an abhorrent practice as abortion.
