Florida Courts: Incompetent or Criminally Negligent?

This is what I am seeing from the Judges view. I have a person who only has a record of drug use. The only other violent charge happened eight years ago, will treatement be an option? (the judge would not be able to consider the kidnapping due to the not guilty jury verdict)Even if he had gone in for five years, who can predict with certainty that he wold not have killed some other victim in 5 years.
Here is another tidbit. If he was subject to a possession with intent to distribute, the law may have already changed. IOW the break Smith recieved would not be available today.
Most people who screw up a second chance treatment like smith recieved, will only end up using drugs again, not killing someone.
Hopefully O'Reily will get the actual court transcript of what happened on that fateful day and we can all see and read exactly what happened.

I am sure that there was more than one fateful decision leading up to this tragedy.
I would like to get all the court transcripts in chronological order along with the details of each judge's decision. That would give us a pretty clear picture of how this leech dodged the system, and it might give us some insight as to how leeches like George Felos and Michael Schiavo are dodging the system as we speak.

Good news today. Victor Crist of the Fla. Legislature wants to "take discretion out of the hands of Judges". Wouldn't that solve many of our problems in Florida with activist, bleeding heart, pro-predator Judges? The truth be told, they are incapable of making decisions. They are simply waiting for their pensions $$$$$$$$$$. It's not about protecting the public - it's about money and showing up every day and pushing paper. PAPERPUSHER EXTRAORDINAIRE, JUDGE RAPKIN. VOTE HIM OUT OR INVESTIGATE AND IMPEACH!!! I hope Bill O' Reilly has Carlie's dad on his show and I hope Carlie's dad fights from NY to get a Carlie's Law here in Florida. CARLIE'S LAW (Jim King would probably vote against it. He regrets Terri's Law). JIM KING IS A BAD REPUBLICAN. BAD, BAD, BAD.
THE STATE OF FLORIDA CONDONES VIOLENCE AGAINST WOMEN. Someone prove me wrong.
Judges always spin "I don't have a crystal ball" after someone is killed when the Judge refuses to issue a restraining order, etc. That psychic friend excuse is UNACCEPTABLE. Investigate, impeach. Judge Rapkin should get the rap.

Rapkin is not a competent Judge. Start watching Bill O' Reilly on the Factor or listen to him on talk radio. He's uncovered other accounts where Rapkin was SOFT ON CRIME. That's the issue. Soft on Crime KILLS.

That we know of, Carlie was his THIRD VICTIM. If the probation officer recommended re-incarceration because of a belief that Smith was DANGEROUS, the Judge has a duty to consider the probation officer's recommendation.

I heard today that Rapkin said he was the victim here.
If this man can think that he is the victim when a little girl has been murdered then he is not fit to call himself a man, much less a judge.
He should be groveling at the feet of Carlie's parents and begging for their forgiveness, not making self centered, egotistical excuses....

probation officers actually have very little discretion. They recomend violation for any infraction. FYI there are two type of probation violations, subsantive and technical. subsantive is getting arrested again, not reporting to probation. Technical is not paying mere money due to unemployment or not having enough money due to child support. The latter is not considered serious when it is unintentional. The judges comment that we do not have debtor's prisons is not to be taken lightly. (intentional non-payment is a horse of a different color)
In short, due to the lack of discretion, the probation officer will always recomend a finding of violation.
Here is another twist. The judge may violate the defendant, sentence him to time served for the violation and put them back on probation. When there is a violation of probation it is very rare to get any bond until your violation hearing.

Old Case Coming up on Fox News - Greta - On the Record. JENNIFER ODOM was murdered but her killer never found. Greta is going to raise the possibility that Smith murdered Jennifer Odom. There's also a missing girl in Alabama. Smith had been there before.

In a way I hope that this guy is the one who did it. I hate it but at least it would be helpful for the family to know if he is the perp. Either way Justice needs to be served and florida has got to come to grips with their judicial problems. Sad case but let's hope for the best possible outcome to a terrible crime.
