Florida Courts: Incompetent or Criminally Negligent?

Very much alive until Florida's Criminal Justice System failed her:

CARLIE BRUCIA

Disabled woman who's still alive but Florida's Civil Courts has tried to kill her twice already. TERRI SCHINDLER-SCHIAVO

VIOLENCE AGAINST WOMEN IS NO BIG DEAL IN FLORIDA. Judge Greer denied a lady a restraining order against her boyfriend who threatened her. She was DEAD two weeks later. What did Judge Greer say? something like he couldn't have predicted that. (could have done a restraining order, dufus).

What did J. Rapkin say? that he couldn't have predicted Carlie's murder. WE DON'T NEED PSYCHICS, WE NEED RESPONSIBLE JUDGES!!!!!! FLORIDA NEEDS SERIOUS REFORM and KICK SOME JUDGES OFF THEIR PEDESTALS.

Judge Rapkin should be at the very least impeached. This isn't his first outrageous decisions, as Bill O'Reilly pointed out but at least the third one. There might be more.

The decisions by the judges in the Terri Schiavo case boggle the mind with their blatant disregard of the law. A dictatorship of judges is emerging. They disregard and/or make laws to further their own agenda or in response to bribes/blackmail.

As Judge Rapkin said himself "he just had a piece of paper in front of him." Well, that's entirely the wrong answer. He has unfettered access to criminal records and he also failed to heed a warning from a probation officer who stated the guy was dangerous. What did Rapkin do after they found Carlie's body? He blamed the probation dept and said "he was afraid." At least he finally woke up but it's way too late and he only woke up because "it affected him personally".

RAPKIN WAS JUST PASSING TIME TO MAKE SURE HE'D GET HIS PENSION. Who knew just a piece of paper could end so tragically?

Governor Bush and House/Senate members who voted for Terri's Law have my gratitude for helping Terri.

The Judges have refused to obey the Executive Order and Terri has no guardian ad litem per that very Order and is still a prisoner with a rent-a-cop.

Florida's AG was on Fox News this a.m. Carlie's murder is another wake up call in Florida re: outta control Judges. Crist will shore up the system imo working with the legislature and Jeb. We need a CARLIE'S LAW now.

In 2002, there were numerous times I ran into Jeb and/or Charlie campaigning. They would not shirk if a shoeless homeless person approached them (not me - often shoeless but not homeless).

It's ashame that there are only a handful of folks in Florida government that Floridians can trust.

Jeb and Charlie's workload is heavy because NOBODY ELSE SEEMS TO KNOW WHAT THEIR DUTIES ARE I.E. JUDGES.

Charlie was known as "Chain Gang Charlie" when he was a Senator. He reinstituted chain gangs.

I'M SURE THEY'VE BOTH BEEN BOMBARDED WITH CALLS AND EMAILS RE: CARLIE.

Why didn't Judge Rapkin look at ANY of the prior arrests back when he gave the predator rehab?

lol--he didn't even look at the offender. That's been one of his excuses. He never ever saw the perp. Just pushed the paper across his desk. Bet he saw the golf course though.

There are a few jobs in our society in which there is no room for error.

The role of judge in this society is perhaps the most important job of all. Judges enforce our laws, protect the public, and whether they like it or not, set the cultural climate for our nation.

There is no room for error in our courts and even less room for negligence.

America's courts have become a millstone around her neck. The entire system needs to be revamped before its too late. Any judges who cannot handle this great responsibility need to be removed from the bench.

Americans are tired of seeing politically motivated celebrity judges destroy our nation one bad decision at a time.

Any and all persons in the Florida court system who allowed this piece of scum to float through, are responsible for Carlie's death.

No excuses....No hiding from the truth....This child's death could have and should have been avoided.

One of my best friends was jailed in TN for speeding tickets. This quote just represents another lame excuse and another attempt at dodging responsibility.

If Charles Manson was brought before me with a bunch of speeding tickets I would look at his entire record and think to myself...'hhmmmm, old Charlie doesn't need to be out walking the streets. I'm going to toss his butt back into jail for these tickets.'

You are right Floriduh voter. Tons of people have been breaking Terri's law since the moment it was enacted.

This should be proof to the people of Florida that their courts only intend to enforce the laws that they deem important. I guess they'll just toss out the ones they don't like.

Are they getting ready throw the Florida constitution out the window because it no longer suites their whims?

You have just taken a huge hammer and smacked the proverbial nail right on its rusty head!

Judges all over this nation are launching a power play that will be the death of our country if it is not stopped. And why not? They have their own personal armies of police to enforce their scummy decisions.

The good news is that there is still time to stop this madness if people will wake up and become active in the fight against judicial tyranny,(active includes actually getting up off the couch and going out to support a Carlie or a Terri Schiavo in their hour of need).

I refuse to live under a judicial dictatorship!

Al Capone was jailed for tax evasion (an unwillingness to pay) even though he committed all sorts of illegal acts.

Vagrancy itself is a charge that can get you locked up.

Rapkin has made admissions about his own incompetency. I think He should go and go quickly. "just a piece of paper" my eye. I would bet a dollar that he's friends with Judges Baird, Greer and Demers. By the time they become judges, they sense of right and wrong and REASON are gone. They are too out of touch to SERVE. But, they hang in there for the perks of being a judge. IT SURE ISN'T TO SERVE THE PUBLIC.

Did the judge choose or was that the offer from the state attorney and did the defendant accept? (probably had a public defender lawyer) Generally the SA makes the offers, the judge does not enter the plea fray.

What was the maximum scoreable sentence under the FL sentencing guidelines? Drug charges as a user are different than beating up other people. His kidnapping case went to trial. There was 8 years distance from his only other case regarding violence.

You are right if he had locked this guy up Carlie would be alive. Of course this assumes that locking this guy up for five years would have prevented him killing someone else when he go out.

I am just saying hindsight is 20/20. It is easy to blame the judge when in fact there is more than one party in the courtroom and when the judge has sentencing guidlines they have to obey. (for example the offer of treatment in lieu of jail may not be discretionary. The SA or Judge may have been required to make it in User cases. I don't know the specifics of his case.)

Yes, there is a long list of people who share in the responsibility for this creep roaming the streets, but it has come home to roost with Rapkin, and he is just going to have to deal with it.

The responsibility for this type of nightmarish court bungle can't just be passed around forever. It eventually has to land in someone's lap, and it looks like Rapkin is going to take the wrap for this one(for starters).

If an airplane crashes due to mechanical failure. The mechanic who made that last critical error gets the blame. He doesn't get to shift the blame onto the 50 mechanics who worked on the bird before him, even though they may have made bad decisions as well.

I'm sorry, but Rapkin knew when he signed on as a judge that his decisions were going to be life or death.

RESPONSABILITY! Its a word that no one in this country seems to understand anymore.

Smith as assaulted another woman in the early nineties. The probation officer rightly looked at Smith's entire record and concluded that Smith was dangerous and belonged in jail. The judge himself on tv stated that he chose rehab for Smith instead of five years. O' Reilly on The Factor is going TO HAVE THIS ON FOX NEWS again tonight. There's another case like this maybe the same judge that O' Reilly is going to talk about tonight. Just a tease on O' Reilly's radio show.

O' Reilly wants Harry Rapkin to get nailed. I agree.

The sentencing hearing in criminal cases has a court reporter. ANYONE can go and order the transcript and see exactly what happened on that sentencing day.

This way we can know if the plea came from the prosecutor of the Judge.

I would not want to see competent judge rebuked because he lacked the ability to predict with 100% accuracy the future.

look at the Rush prosecutor playing games with the FL AG office and FL Bar ethics department. He knew he was responsible and was playing games to CYA. Now he is snagged. It remains to be seen if the Bar burries the ethics complaint by the LLF.

Predicting the future occurs when you are sitting in front of a crystal ball and you have absolutely nothing to go on.

Incompetence occurs when you are sitting in front of a stack of papers that tells you everything you need to know to realize that a scum bag is a danger to society.

This judge didn't need to predict the future. He just needed to exercise some common sense.

You know? I realize that he handled this case the same way a thousand other judges would have handled it, and thats what's so scary.

I have nothing personal against this judge or his family, but this type of judgery was bound to bite somebody in the butt, and it just happens to be Mr. Rapkin's turn.

Carlie's case may be the one that blows the lid off of our pathetic judicial system, and I'm sorry, but I'm too busy feeling sorry for Carlie and her family to have too much pity for this judge.
