Greta again scheduled Terri's story at the TOP of her 2nd half hour (even before Laci and Jacko! Only the Dem primary took precedence).

[video clip of President Bush answering a question] Yes I believe my brother made the right decision.

Greta: Now to Florida, where Governor Jeb Bush just filed a court pleading in his battle to keep feeding tubes in Terri Schiavo. Governor Bush asked the appeals court for permission to present evidence that Terri Schiavo would WANT to be kept alive.

Schiavo's husband is challenging the constitutionality of the law that allowed Governor Bush to order her feeding tube reinserted, six days after it had been removed in October.

Joining us here in Washington is Governor Bush's lawyer Ken Connor, and in Tampa is George Felos, the lawyer for Terri's husband Michael Schiavo who wants the feeding tube removed.

Greta: George, let's you go first, just because as luck would have it, last time I started on Ken, and when we ran out of time I ended on Ken. So I'm going to go right back to you. First, update on Terri Schiavo's medical condition... has ANYTHING changed?

Felos: No. Terri has been in a persistent vegetative state for 13 years; She has no consciousness. Unfortunately that will NEVER change, and her condition has remained the same.

Greta: Is the sole issue in this current court battle over Terri Schiavo, the constitutionality of Florida statute that says that the Governor has the authority to reinsert the feeding tube, or order it?

Felos: Yes. That's the sole issue. What the court is going to decide is whether the legislature can authorize the Governor in essence, to overturn a court decision, and substitute the Governor's decision, regarding an end of life medical treatment choice for that of the patient. And ummm, that's the narrow issue in this case, and that's why the trial judge said that there are no material facts in dispute and he's ready to rule.

Greta: Alright, Ken...

Connor: Well, that's not really the issue Greta. The issue is what role does the legislature play, and what role does the Governor play, in protecting the lives and health care decisions of people who are unable to protect themselves?

Connor: In this case, we have a profoundly disabled woman, whose husband with a GROSS conflict of interest, is trying to starve her to DEATH. She wasn't afforded the benefit of an independent guardian-ad-litem WHEN the decision was made... and the legislature and the Governor had...

Greta: Which decision? This has lingered in the courts for a long time. What year are we talking about?

Connor: When the decision was made to starve her to death. When the court approved this SCHEME that mister Schiavo has embarked on to starve his wife to death.

Greta: Isn't it filed... According to the plea that the Governor has filed... I guess you filed on behalf of the Governor... you don't represent by the way, Terri Schiavo's parents? Just the Governor?...

Connor: No, I represent Governor Bush, thats it.

Greta: Alright, ...that Governor Bush WANTS to present evidence, and the trial court judge has said No, is that right?

Connor: Yea, What a NOVEL concept that a litigant should offer evidence in support of their position!

Greta: What evidence exactly, does the Governor wish to present to the court?

Connor: Issues that relate DIRECTLY to what Terri's WISHES would be, under the circumstances...

Greta: Right, witnesses?

Connor: Well yes absolutely, witnesses. For example, we know that in the CIVIL case, that mister Schiavo, wherein he claimed MILLIONS of dollars for damages for his wife, NEVER told the jury that his wife wouldn't have wanted to live under these circumstances. He put in evidence, of a LIFE-CARE plan, that would have cost, MANY a...

Greta: Let me get George in to respond, because I've got to try to make this even. George, what's your response to that?

Felos: Sure. Well first of all there's no scheme... These charges against mister Schiavo have been leveled at him for the past six years by the parents. And unfortunately, the Governor has been trying to join in that bandwagon and try to demonize my client. The twenty judges who have looked at this case have all rejected that. And I think its obvious what's going on here. What the Governor doesn't want to talk about is the fact that the legislature gave him unreviewable authority to impose his will on Terri Schiavo. The Governor wants a jury trial in this case, but the fact is, a jury can say, Terri doesn't want to be kept alive artificially.

Greta: Can I get Ken in?

Felos: Yet the Governor has ignored that.

Connor: But point of fact there Greta, is that mister Schiavo and mister Felos are TERRIFIED of trying this case before a JURY. They know that they will NEVER be able to persuade a jury that this was Terri's wishes under these circumstances. The evidence simply will NOT support that.

Connor: NO reasonable jury, no jury of ordinary men and women vested with good common sense would EVER accept this proposition.

Greta: Alright, I've only got 45 seconds left and we're on the hard break, so I've got to hit the hard break. Is there anything short... Either one of you guys have ANY idea short of battling this out in the courts, that would be a GOOD way to resolve it for the family? Because you've got parents, you've got Governors, you've got Terri... Is there ANY way to get in one room and resolve it?

Connor: Sure, I think mister Schiavo, who has ABANDONED his wife in preference for another woman, could consent to have her PARENTS have custody, and take care of her.

Greta: OK, let me quickly get George in here before we run out of time... George?

Felos: Well, demagoguery is not going to solve this. The fact is, mediation was tried... Its best if the families can work this out, but when they can't that's why we have the courts, which are transparent, and they follow the rule of law. We don't have ahh, kings or POTENTATES, or dictators, in our system of government to impose their will on the courts.

Greta: Alright, George I've got to cut you off, because unfortunately this is the break where I have NO latitude. Gentlemen, Thank you. We'll await the court's decision.

Statesments like that by Connor is extremely effective and detrimental to Mikey. I'd say all gloves are off since the courts won't allow a proper and fair trial. Connor would be wise to "try the case" in the media by repeating more statements like above as well as more damning questions.

I didn't see it, but reading the words, Conner wins hands down. He had good law and he appealed to human concerns and common sense. He was far more persuasive. Felos sounds evasive and legalistic, and people usually detest that.
