We can't trust SCOTUS to give us liberty and self-governance

By now you've heard about this week's decisions from the U.S. Supreme Court. Conservative Review's Daniel Horowitz sums them up well in a piece entitled, "Conservatives get massacred by fake 'conservative' SCOTUS":

Within 35 minutes today at 10 a.m. Eastern, what some thought was the most conservative Supreme Court of all time concocted a fundamental right to transgenderism in the context of labor law, erased the Second Amendment, and interfered with a state death penalty case, but declined to interfere with a California law that criminalizes law enforcement cooperation with federal immigration agents.

Taken in totality, the “conservative” legal movement, which has promoted the idea of “appointing better judges” rather than fighting the entire concept of judicial supremacism, has failed miserably. This was its Waterloo.

Whatever you believe about each individual decision, you can't deny that the Court has -- once again -- significantly expanded the power of the federal government. Rather than leave policies about employment and gender to local and state governments, they've effectively rewritten federal law to cram a policy down the throats of every American citizen nationwide.

By contrast, they have failed to settle the disputes around gun rights and the Second Amendment -- a provision, unlike gender, that can actually be found in the Constitution.

If you were hoping that Washington would fix itself, this should be your wake up call. 

Washington will never limit its own power. The Court, no matter how "conservative," will never rule to eliminate judicial supremacism. Their rulings have the force of a constitutional amendment. Each decision proposes and ratifies a new amendment without the approval of the states and the people, and there's no recourse. 

The only way to reverse these decisions is via another Court decision or a constitutional amendment. Since the Court will never reverse a 6-3 decision and Congress will never propose an amendment limiting the power of the federal government, the states and the people must take charge.

Article V of the Constitution allows the states to call a convention to propose constitutional amendments. These amendments, once ratified by 38 states, can limit the power and jurisdiction of the Supreme Court, impose term limits on federal officials (including justices), and mandate fiscal responsibility in Congress.

This is the only recourse left to We the People to restore the balance of power between D.C. and the states. We cannot let nine non-elected justices continue to dictate policy for all 330 million Americans. The Founders gave us a tool in Article V to end federal overreach, and it's time we used it.

Thomas Jefferson declared in letters that the decision in Marbury v. Madison and the concept of judicial review were unconstitutional and not actually law. Of course Congress thought otherwise because it passes the hot potato to the Court of Supreme Whim. Americans have been tolerating this judicial tyranny for over 200 years now. The Dred Scott decision arguably led to the First Democrat Republican War! It's way past time to end this rule of 9 black robed lawyers.

We need another conservative justice on the SCOTUS, a real one.

Everyone was convinced that when Kavanaugh was seated, there was a 5-4 majority, but it only forced Roberts out of hiding. He can't pretend to be conservative any more...

The future of our 244 year old republic hangs in the balance.

12 year congressional term limits as well.

There are 15 states already signed up. 19 more and it’s a done deal. A lot of folks already believe we are on the edge of Civil War. Some around here foolishly want to see it happen! The last Democrat-Republican War killed 600,000 Americans. At the time America did not have nuclear, chemical or biological weapons. Does anybody believe the left will hesitate from using them if it is on the losing side? American blew it’s chance to use Article V to prevent its first Civil War. It dare not blow it again!

Thomas Jefferson had it right. We need to take away their power of the final word. A mechanism for overriding their decisions is needed. Perhaps one where the President can force an up or down vote in Congress on any ruling. If the court loses the vote then the President gets the option of another up or down vote on the removal of the judges responsible with 3/5's needed to toss them out!

The biggest question, and the most paradoxical one of all is, how can Americans, any of them, label a SCOTUS decision as ‘unconstitutional’? Where do citizens go to undo an unconstitutional SCOTUS decision?

There have been far too many court decision which can be categorized as being “activist” in nature, since they’ve been redefining the laws of the land, where laws are supposed to be defined and passed by the legislators, local and state and national

It’s not insane. Would you rather we all vote on everything? Look at how that works out for California with voter initiatives or how Gore & Hillary would’ve been presidents of the United States.

I've come to the conclusion that the 14th pretty much wiped out the 10th. By giving the Federal Government the power to determine what is equal protection or not it opened up a can of worms that the purveyors of cosmic justice can pursue endlessly and have.

The way to move forward is Article V. The Founders knew it would come to a day like this and gave us this neat reset button.

Absolutely! Which is why some pretty amazing miracles happened during the Revolutionary War. It's why Benjamin Franklin specifically asked for divine guidance during the Constitutional Convention and I'd say it worked!
