I have little doubt the deceased was ... a problematic individual.

Issue is the legal justification for confronting him, with deadly weapons at the ready, on a public street while having no immediate knowledge of criminal guilt.

There’s a critical difference in this vs Zimmerman, but memory of details then is fuzzy.

I wouldn’t touch that at all. I also wouldn’t want to be on the jury. The left got a race issue just in time for the election. Maybe St. Jogger didn’t deserve to die but here we have another loser of society running around up to no good like the other Saints Skittles,Blunt and Loosie. In the old days,the Pop would whip the ass of the boy running around like that.

The people who allegedly did the shooting were associated with the potential prosecutors since the father of the father/son duo was a former employee of the DA. Any DA that did not recuse himself would be an idiot and obviously corrupt. The prosecutor who actually declined to prosecute made his judgement on the grounds that the men were acting in self defense when the shots were fired, and that they were there in the first place acting as citizens in an attempted citizen’s arrest.

Our experience with Trayvon and Gentle Giant obviously got slanted by the media to push a narrative. This case appears somewhat different in that the guys went after him because he had committed a burglary. The tapes of the site where he went inside and looked around clearly show he did not take anything, and didn’t break anything to get in.

Why does a black person not have a right to go jogging? Just because most joggers you see running up and down the street are white? It really is embarrassing to be around people who are so stereotypish that if he’s black and suspected of a crime then he must actually have committed the crime.

I have been looking at this for days. I have tried to find anything at all that would get me to change my mind about it, just to be sure I am not reflexively taking one side or another based on media coverage. Still looking.

I do not believe it is OK to grab a gun and jump in a pickup truck to chase down a burglary suspect. Rape or murder, maybe. I do not believe it is OK to brandish a firearm at anyone not brandishing one at me. Holding him at gunpoint where guilt has not been proven and probable cause has not been established seems a bit rash. I conclude that those guys are stupid bullies and a-holes. They should have known better.

As far as them defending themselves and standing their ground, it seems a bit twisted around that the black jogger cannot stand his ground, and certainly trying to fight someone who is holding a gun is not the smartest thing in the world, but damn!

All of the actions stem from the moment the two guys got in a pickup truck with guns. Everything after that was testosterone and adrenaline and stupidity.

Doesn’t fit the agenda, especially in an election year.

Unlike Zimmerman or Ferguson, this time the race batters have an actual case on unjustified killing.

My guess the shooter gets murder, dad in truck bed gets manslaughter.

The doer worked as an investigator in the prosecutors office for like 30 years. Probably hard to find one who didn’t know him.

Could this simply be another violation of the “Safari Rule”?

As was learned in the Travon Martin case, it is a violation of the “Safari Rule” to make eye contact with blacks you believe are acting suspicious or especially by exiting your vehicle. Those actions will not be tolerated by a black, as you are deemed to be “dissing” them. You must understand that blacks are simply unable to control their response to being dissed. Remember, if you commit either of those two provocative actions, whatever happens next will be your fault.

To put it bluntly, if you commit either of those two actions you are putting your life in danger and it will be YOUR FAULT if you die, regardless of any other facts (ie other facts will have no bearing upon your obvious guilt). And, if the black dies you will be guilty of murder.

If you have any doubt about the validity of this rule, just ask Benjamin Crump...the most honest lawyer in the Universe.

Fortunately the situation is not governed by what you think is “okay” but on the laws of the State of Georgia.

The idiots in the truck appear to be within the law.

St. Jogger could have stopped. He could have held his hands in the air. He could have told them to stuff themselves and walk away. Instead, he charged the guy with the shotgun and tried to pull it away from him.

Right or wrong, that was fatally stupid.

Unless the initial prosecutor lied in his written and signed explanation of why he didn’t prosecute, there is little chance these guys will be convicted. And DA Barnhill wrote the letter with full knowledge the case was to be reviewed by a 2nd DA. I suspect the new prosecutors, after reviewing the actual evidence and statements, are reaching the same conclusions.

No prosecutor wants to take a case they think they will lose, particularly one with high media interest that will follow them the rest of their career. But now people are afraid to dismiss because of the Trayvon Martin type media narrative about two white guys hunting and killing a black jogger for sport.

Exactly. This has become a no-win case. The evidence is against the prosectution. The chances of convincing a jury of guilt beyond a reasonable doubt is exceedingly small.

But the Media is howling for blood, and the politicians fear nothing more than the Media.

Prosecutors are politicians.

No, it is not. You are mistaken about the law.

Anyone can "confront" anyone else, as long as it is not a threat, "fighting words", or physical. There may be a couple of other exceptions I do not recall, but it is very likely they do not apply in this case.

"with deadly weapons at the ready" is a right protected by the Second Amendment and by the Georgia Constitution and Georgia statute.

"on a public street" is exactly where you have a right to bear arms.

There is no evidence a citizens arrest was ever attempted, or that any weapon was pointed at Arbery until he attacked Travis McMichael. In any case knowledge of criminal guilt is not required under Georgia law, for a citizen's arrest, only probable cause.

No evidence has been presented that either of the McMichaels threatened Arbery, except Travis, after Travis was attacked by Arbery.

Doesn't "stand your ground" imply that you are going to "stand"? As in not leaping forward to attack someone?

Had he just stood, he would not have been shot. He should have stood his ground.
