Black or white it is scary that they are allowing people like this to go armed into public to enforce the law.. How did this guy get through training?

This case is in no way manslaughter. But it is manslaughter. He did not go there to kill her, no premeditation. He was responding to a perceived threat. He made a mistake. That's always been manslaughter, and would be still if it weren't so politically charged and DA thought he could get reelected without a murder charge.

With solid video evidence, this cop should cop a plea. As we learned during the Guyger case, Texas murder law is a bit strange. Of course, this happened on duty, so we are in some different territory here. Considering how quick he was fired/quit and charged with murder, he will be lucky if they will accept Criminal Homicide, but he might be able to cop a plea for Manslaughter. If Murder, he likely gets a stiffer sentence than Guyger, as he is not a member of any protected class. I’m sure he followed the Guyger trial, so he knows the score.

He was there for a welfare check.
He had a duty to call inside before deciding whether there was a threat or not. We expect this out of law enforcement.

No. This wasn’t manslaughter.

The bodycam video included blurred still frames showing a gun inside the home. It’s unclear if the firearm was found near Jefferson and police have not said that the officer who shot her thought she was holding a gun. Merritt blasted the police department for releasing the image, which he said was legally owned by Jefferson, who had a concealed carry permit.

Has to be 2nd degree murder.

Second-degree murder is defined as an intentional killing that was not premeditated. In some states, second-degree murder also encompasses “depraved heart murder,” which is a killing caused by a reckless disregard for human life.

However, I think manslaughter is probably the more apt charge in this case. Not excusing his actions, but I think it is a tragic accident committed by a relatively new cop who blew it badly.

Manslaughter - the crime of killing a human being without malice aforethought, or otherwise in circumstances not amounting to murder.

It's a sad situation all around.

What should matter is an INNOCENT (at least in this situation) person was needlessly killed.

Not the color of the cop or woman.

But that is the height of naivety on my part.

No he’s done and going away for a long while.

And any gun that wasn’t in her hand or lap doesn’t really help him.

Well, they went into the house after the woman was shot, found a gun in a nightstand and took a picture of it and tacked it onto the video to muddy the story.

The East Allen Avenue shooting was the seventh time since June 1 that a
Fort Worth police officer has shot a civilian. Six of those people died.
The determination of police Internal Affairs Unit reviews of those cases
or whether grand juries have considered them was not clear.

Body-worn camera video police released shows two officers using flashlights
to check the perimeter of the house, inspecting two doors that are open
with closed screen doors. At the back of house, one officer appears to see
a figure through a dark window, and he quickly twists his body to the left.

“Put your hands up! Show me your hands!” he shouts through the window,
his gun drawn. He then fires a single shot through the window.
