A federal appeals court on Friday handed a victory to travelers who object to invasive screenings at U.S. airport security checkpoints, saying screeners are not absolutely immune from lawsuits accusing them of abusive conduct.

It is a victory for Nadine Pellegrino, a business consultant from Boca Raton, Florida, who with her husband sued for false arrest, false imprisonment and malicious prosecution over a July 2006 incident at Philadelphia International Airport.

She was eventually jailed for about 18 hours and charged with assault, making terroristic threats and other crimes, which she denied. Pellegrino was acquitted at a March 2008 trial.

I live just outside Philly.
Most TSA are grumpy Black chicks, half with Islamic head gear.
I have never left or landed in Philly on time.
Then there was the “You ugly” incident when a black woman harassed a white dude in Rochester:
Shes a real looker herself.
She probably got a 4.0 in English as well.
Finally decided that I wasn't a threat and let me board the plane. Been hesitant to file a written complaint in fear being "red flagged" for future flights. This is just not right.
That’s awful. I think it’s worthy of a complaint, but I would suggest contacting a lawyer first.
I got in their face. They wouldn’t let me fly that day but it was worth it. F them.
“”I am sympathetic to the concern that the current legal regime provides no obvious remedy” to people like Pellegrino, but expanding the immunity waiver “lies beyond our purview,” she wrote.”
Government is supposed to be for the people, not above the people. I think this is a good decision.
Then there are the TSA employees with a rye sense of humor.
One black guy in Newark was instructing people to remove shoes but not jewelry because, as he said, “If you wearing it the women X-rayin’ it can’t steal it.”
Several years ago I flew back from HK with my foot in a walking cast due to a broken ankle. A TSA screener in Anchorage asked me to take my shoes off. I pointed to the walking cast and said I couldn’t. He took me to a chair and used the wand and swabbed down the cast and shoe. Then he looked at my passport and asked me to spell my name, the date I was born and so forth. Finally he asked “Quickly without thinking about it, What is the first name of your three best friends?” (I had to think fast because one of my friends in HK is a man named Abdul who is an ex-Muslim.) I answered, Paul, Ed and Brett.
He said good, “I don’t you look like the kind of guy who’d blow up a plane.”
In times of conflict, the job of searching ships, trains, and aircraft coming into the U.S. used to fall to the Coast Guard. It still should.
That way if there is anything untoward which happens the Officer in charge is responsible and as all of personnel are subject to the UCMJ the matter will tend to not get out of hand and be dealt with harshly.
Used to fly out of LAX fairly often, and there was a joke that to be TSA, you had to be a negress about 5' tall and weigh at least 250. It was essentially a closed shop.
I agree. There must be some limit to “qualified immunity” and this case went beyond the scope of the duties of the TSA. False arrest and malicious prosecution should not only result in financial awards, but should have led to charges against those who made the false arrest.
A “rye” sense of humor? I barley understand wheat you’re saying. You oat to choose your words more carefully so you don’t cornfuse people.
Its about time.
Unreasonable Search and Seizure.
Snort!
This statement tells you all you need to know about judges, as .gov employees.
An E3 guard at the entrance to any military base displays eminently more professionalism than many in the TSA.
You should. Hope you will.
TSA=thugs standing around.
I haven’t flown since 2005 and this is why. I drive everywhere now.
The TSA is proof that the terrorists have won “The War on Terrorism”.
