How about kidnapping and unlawful restraint? Same defense though: he was trying to keep a drunk distraught naked woman from wandering off where she might come to harm.
The woman witness puts the lie to that scenario though. All he has to say is “you look after her. I’ll get her clothes and call an uber.”

There are tons of domestic violence cases in which the abused spouse (or whatever) doesn’t ever file charges etc. It’s still abuse. This woman clearly has a few screws loose, but this guy is also clearly a dirtbag and should not have been excused for what he did.
Remember the NFL player (Ray Rice) who was caught on tape beating his then fiance in an elevator and dragging her out of the elevator unconscious? She didn’t file charges either, and eventually married him, but he was guilty as hell lost his NFL career because of it. He did win a wrongful termination suit against the NFL, but no team ever picked him up to play again.
If I saw a neighbor hitting/assaulting his wife, and dragging her back in the house after she ran away from him, I would testify against the dirtbag - even if she didn’t want me to. That’s just the way it is.

I think we’re on the same page. I’m not sure there was rape either, as no one else was in the room. That said, it is assault. I do know where you’re coming from though. Several years ago I was in an ice cream shop and this guy was pushing his girlfriend around, and she was very upset. I stepped in and told him to stop or we would be having a problem. His girlfriend then stepped in to defend him. So yeah, things aren’t always what they seem, but I would still do it again.
