Vanity-What’s happens if the Supreme Court (John Roberts) denies Trumps National Emergency?

Posted on 02/16/2019 6:12:11 AM PST by Bigtigermike

What’s the next possible course of action? Is it over for the wall? I don’t trust that guy and it’s obvious that everybody in Washington DC saved for a small group is trying to do everything within their power to deny Trump his key signature issue. They’re determined that he loses the election next year

I think any lawsuit needs to be expanded to include all declared national emergencies, don’t let it be specially for the wall.

It would be yet another clear signal that elections no longer work.

” Vanity-What’s happens if the Supreme Court (John Roberts) denies Trumps National Emergency?”

They will hand over executive power to Congress. Doomsday

Do an Andrew Jackson and just say, “Justice Roberts has made his decision, let him enforce it...”.

Just modify obama’s DACA EO to build it.

Then President Trump immediately reverses and abolishes ALL OTHER National Emergencies instituted under this Law by past Presidents.

Agreed - this has to apply to all national emergencies.

If the SC wants to restrict the power of the executive office (which I’m not against) then they must be forced to allow them all or restrict them all. Not say THIS one doesn’t count because we don’t feel like THIS one is an emergency but the other 30+ get to stay in effect.

I have little faith in Roberts, too. Seems non-Constitutionalists have a different sense of jurisprudence. Instead of looking at a given action and the underlying law, they start with a desired outcome, then find a way to get there, often with outrageous twists to achieve the objective.

I admire President Trump’s determination and fight more every time I see him speak. If the wall doesn’t happen, it’s because of the fierce opposition from nearly all sides.

I’m sticking with him - he has already won my 2020 vote by being the rare Republican who doesn’t try to make nice with the enemy.

‘Tar.

yes, of course...by all means, go ahead and try and get near the Chief Justice of SCOTUS...

Its when not if. Trump pretty much guaranteed it when he signed the Rats open border bill and sealed it by saying “l really didn’t have to do this” when he declared the emergency. He’s not a stupid man so what are we to think?

Rather simple answer. Start arresting Deep State Criminals. All the RATS will scurry. Letting them go unfettered for over two years tells them that Trump isn’t serious.

This should be in the 5th Circuit not the 9th...

He will most likely rule that the National Emergency is not an emergency so too bad Donald. Kind of like the Affordable Care Act was not a tax when passed, but a tax when challenged!

According to Andrew Wilkow NO ONE, even the SCOTUS can deny Trump. 10USC2808 and 2803 explicitly give the president the power to act without recourse. The only thing SCOTUS can say is the law, as written is unconstitutional and no one has challenged the law since the ‘70s and used by 5 previous presidents. Even if they say that the law stands until revoked by Congress and that ain’t gonna happen.

According to Wilkow, Congress can’t stop the President even with a 2/3’s majority. There is apparently no provision for that type of action.

“JOHN MARSHALL HAS MADE HIS DECISION; NOW LET HIM ENFORCE IT.” -Andrew Jackson

Interesting read (ignore the paragraph regarding Clive Bundy).

It’s been over 100 years since this solution was applied, so consider it “figuratively.”

Game over.

Because it has become crystal clear that Congress, under no circumstances, will build a wall. Nor will they make any changes in the law that would stem the flow of illegal immigration. And they are sending the message that there is nothing voters can do about it.
