Michael Skakel free: Supreme Court won’t hear case

WASHINGTON (AP) — The Supreme Court announced Monday that it is leaving in place a decision that vacated a murder conviction against Kennedy cousin Michael Skakel.

Skakel was convicted in 2002 of the 1975 bludgeoning death of Martha Moxley, a 15-year-old who lived across the street from the Skakel family in Greenwich, Connecticut, and whose body was found in her family’s backyard. Both Skakel and Moxley were 15 at the time of her death.

The high court’s refusal to hear the case means that a 2018 decision by Connecticut’s highest court throwing out Skakel’s conviction will stand. Connecticut’s highest court based its decision on Skakel’s attorney’s failure to seek out an additional alibi witness.

Though it would be difficult, the state could retry Skakel, who is a nephew of Robert F. Kennedy’s widow, Ethel Kennedy. The state has not said how it would proceed if the Supreme Court declined to intervene. Top Connecticut prosecutors said Monday they appreciated the Supreme Court’s consideration of their request to hear the case, but declined further comment.

I did not remember that Skakel and Martha were both only 15 years old at the time.

So, he was FREE for 27 years PRIOR to his conviction, served 16 years, and is now FREE again?

I guess now his only choice is to run for office! *SPIT*

Failed to SEEK OUT? Is there any reason to think "an additional alibi witness" existed?

The movie “Chappaquiddick” is chilling. That poor girl was alive while The Swimmer and his minions puttered about on the bridge wringing their hands about how The Swimmer’s Presidential aspirations were done.

Turns out all they had to do was call a tow truck and yank the car out of the water. If they had, “Chappaquiddick” would never have become a household name and there may have been a second President Kennedy, God forbid.

Connecticut’s Supreme Court reinstated Skakel’s conviction in December 2016, ruling 4-3 that Skakel was adequately represented. That decision didn’t last. After the justice who wrote the majority opinion retired, Skakel asked that the decision be reconsidered, and the court reversed its decision.

"Your Honor, you can retire ... or mysteriously disappear."

I’m not defending him, but 16 years in prison for a killing someone when you’re 16 years old is actually a pretty reasonable punishment when looking at what MOST courts would do.

It was always a bizarre case in that he was tried as an adult only because he wasn’t arrested for the crime at the age of 15.

The violent deaths of John, Robert and John Jr. were shocking. All so young.

Then there are these relatives; Skakel & William Kennedy Smith (famous for a well-publicized 1991 rape trial in which he was acquitted) and dear old Ted & Mary Jo Kopechne.

LMAO.

I remember that part of the case. He claimed he was masturbating in a tree outside Moxley's window to establish a reason why his -- uh, "DNA" was found at the scene.

Best comment I heard at the time:

"I would have confessed to the murder before I ever admitted to something like that."
