COLUMBIA, Mo. — If a man asks a woman out on a date, and he is taller than her, can that be considered "sexual harassment"? According to a former University of Missouri vice chancellor, the answer is yes.
Court documents filed by a black male student (John Doe) at Mizzou quote testimony by the former official, but the university calls Doe's claims "inaccurate" and "out of context". Doe was suspended from the University of Missouri for four years due to findings from a Title IX case is suing the school for racial and sexual discrimination. School officials ruled that Doe was guilty of sexual harassment because his size and gender gave him "power" over a female he pursued romantically.
The lawsuit, originally filed last December, says that in two other very similar Title IX investigations, the university gave much lesser punishments to two white students.
Court documents say that Doe pursued a female dance instructor romantically for several months, sending her 30 messages on Facebook. It alleges that the woman did not initially tell Doe that she was not interested, but after several messages she told him that she was not interested in any kind of romantic relationship. In a deposition filed by Doe's attorneys, the woman who was Vice Chancellor of Student Affairs at the time of the investigation testified that she believes a man asking a woman out for a date more than once if the woman has previously turned him down is an 'unwanted sexual advance'. She also testified that Doe's actions could be considered sexual harassment because of his large size...
The investigator also noted that Doe expressed concern over how dance instructors treated males. She wrote: When I met with [Doe], he asserted that there was gossip about him within the Rec Center and stated that he feels hurt. He claimed that he did not understand what he did to upset people. He expressed frustration at not being selected to be an employee at the Rec Center. He also expressed frustration that the...instructors either assume male customers are gay or that they are there to prey upon women.
If it is harassment for a tall guy to ask out a shorter woman, what about a tall lesbian hitting on a shorter coed?
