Almost every President has used recess appointments to appoint judges, over 300 such judicial recess appointments before 2000, including 10 Supreme Court Justices. New Jersey judge William J. Brennan was appointed to the Supreme Court by President Dwight D. Eisenhower in 1956 by a recess appointment.

Not a good idea. When that happens, there will be binding decisions of the lower Court that SCOTUS is hearing on appeal.
So, actually, a tie on a lower Court’s decision to approve blanket amnesty for illegals, or approving confiscation of your guns gets a tie, the lower Court decision is binding till a 9th Justice is seated. Then the case CAN be heard again for a tie breaker.
10 Supreme court justices have been recess appointments. If the Republicans lose the Senate, Trump should appoint one the day after the election, before Congress returns.

Someone on another thread suggested that President Trump then nominate Hillary and insist that, prior to senate hearings, there be a detailed, extensive and in-depth FBI investigation going all the way back to her high school days. "Take as long as you need, boys!"
It would be worth it just to see the Dems frantically oppose an FBI investigation.

Sorry, but a lifetime appointment is better than a TEMPORARY appointment (by the end of which a Leftist President could be in office) any friggin day and it certainly is now.
Well, you don’t seem to be disagreeing too much. Gives more time to confirm anyhow (and less of an excuse), and the appointed justice could do some good work while there.
And before the Twenty-Second Amendment, there would be less of a possibility of a leftist president getting in after an eight-year period (only less rather than none of course).
