Can I sue the State of California for not protecting me?
I am pretty sure they never advertised it as a “snack.”
Much of the lead-ingesting cases and resulting mental capacity damage has been done in low-rent/ownership tenement row-houses in the inner cities.
The children were allowed to crawl around the place unsupervised and when they could stand, the first place they where they could reach was the windowsill.
The blame for this was mainly on lousy, don’t care landlords, unattentive or neglect parents/siblings, and just the aging of the paint.
Also the use of cheap paints in rental units and projects.
Enough blame to go around the block, sadly.
The ad was from 1904? Suing over what? Lead paint was legal back then. They didn’t remove lead from paint 1970’s. Gee we had lead in our gasoline.

If I was a company I would ban sales to CA. Many gun and ammo sellers do.
Oh, good grief. The company started in 1904 and promoted lead paint over several decades, so until maybe the 1930s or 1940s. Leaded paint and gasoline were fairly commonplace until sometime in the 1970s.

And there were people who said putting that lead in was going to poison the hell out of it. People knew lead was poisonous back then, they just figured it was either diluted to harmlessness in air or sequestered permanently in paint.
Arguing that angle with the generally accepted practices and standards of the time would probably garner a win but arguing we just didnt know is probably going to choke and have terrible optics too...

Sherwin Williams stop making lead paint since 1943. That’s 34 years before it was banned. The judges are basing charges against Sherwin-Williams on ads that ran in the Los Angeles Times and San Diego Union... in 1904. That’s over a century ago.
Next best paint happens to be Behr, which I've also used.
Tip: if you find a color you like at SWP's stores but cannot afford the paint, take the color chip to Home Depot or Menards and have them scan it in and use Behr Premium Coverage paint. Dead ringer color-wise for SWP.
