‘It’s OK to shoot down drones’, say Swiss legal experts

If a drone is invading your personal privacy, you are entitled to shoot it down and aren’t liable for damages, according to new findings by Swiss lawyers.

Drones are increasingly popular with private individuals in Switzerland for recreational use and to take aerial videos, but the remote-controlled craft can also be used by for spying on individuals or taking unauthorized photos — for example of people sunbathing on their balcony.

Until now, legal opinion has held that victims of drone surveillance cannot defend themselves; but Basel lawyers Jascha Schneider-Marfels and Sebastian Kaufmann say that according to their interpretation of the law, people who are being spied upon by drones are justified in shooting them down, 20 Minuten reported.

“A drone pilot who goes against the law by invading people’s personal privacy can expect that the person affected will defend themselves — whether with a high pressure water jet or a net gun,” Schneider-Marfels told the paper. …

A laser pointer at the camera lens would probably ruin the camera on those drones.

That’s as good as shooting it down

What happens if you miss and hit someone, injuring or killing them?

Better join the NRA and learn how to hit the target, not your neighbor.

Then.. whatever happens to the offending spybot is up to the imagination.

My daughter was trying out pistol shooting for the first time - she was terrible. After she got done (she got a bit better towards the end) I handed her the shotgun with #4 shot. (She is awesome with a shotgun, and real good with a rifle.) It destroyed the paper target and the stake that was holding it.

I figured she could use the satisfaction! I imagine the same might be said for an annoying flying drone. Of course one can’t shoot a shotgun up in the air just anywhere, whereas a laser you can.

A quick search came up with a laser might do permanent damage, might not. Several folks claimed that a drone is considered an aircraft, and shining a laser at an “aircraft” is illegal (20 years in prison).

I have no idea, as others mentioned a case where a drone was shot down with a shotgun, and the drone was determined to be “trespassing”.

My argument would be to anyone complaining, “Would you rather I had used a shotgun?”

The only case I remember reading about was where a man blew a drone out of the sky that he thought was spying on his daughter in the backyard pool. In reality, the drone was taking photos of the vacant house next door for a realtor.

If I remember right when it went to court the jury fined the homeowner for discharging a firearm in the city limits and the realtor admonished to knock on the doors of occupied houses next door to where he was taking photos but did not require the shooter to reimburse the cost of the drone.

But, I could have remembered it wrong.

They specified with a water jet (a hose) or a net. They sell devices that launch expanding plastic nets about 20 feet into the air to snare drones.

I have no idea what jurisprudence in the U.S. says about that.

This is an example of the don’t-tread-on-me side of the Swiss that not even Hitler dared to test.

Every Swiss reservist keeps a government issued rifle in his home & Swiss are huge gun owners unlike the rest of Europe.

This ruling could soon have snoopy drones being blasted out of those clear Alpine skies.

You own the airspace above your property. Up to the FAA minimum safe altitude. Higher if you have a valid reason.

Charge the UAV operator by the minute. How do you find them? They are short range, must be flying by line of sight and just follow the drone as it returns to the operator.
