It was perceived at the time that it was "illegal" just like the whole 10 Commandments/same sex "marriage" opinions based on un-enumerations and opinions contrary to Natural Law/ the Social Contract. That was the point. In 40, Madison appealed to merits and enumeration in what was best for the people even if it went against the technical aspects of the law. Fortunatley for Madison the central government was extremely weak to do anything about following the technicalities. That is the main difference between now and then. Moore was doing, and backed by what was best for the people of Alabama. The essence of the 10th Amendment.

Also the Anti-Federalist did not "compromise" (No parties at the time, Federalists were first to emerge after GW election), George Mason and two others of legislative importance did, but many AF knew the Constitution was flawed even with a BoR.

They just stopped appealing after ratification, reloaded, and came up with the Anti-Administration Party which included Madison because he realized he screwed up. Disobedience in the face of laws that went against the Natural order was the hallmark of the founders; the procedure to repeal the AoC was just one of many examples.

And since Marbury vs Madison, all USSC rulings have been considered the law of the land.

There has never been a bigger or more blatant unconstitutional raw seizure of power in US history. John Marshall should have been tarred and feathered, and thrown in the Potomac.

He was kicked off in 2003, re-elected and suspended in 2016. Resigned to run for Senate (Prompted by SC ruling but technically was not kicked off again officially due to resignation). Apparently the people of Alabama like Moore and in the spirit of #40 and Madison, is fighting for the people of Alabama despite everything.

Founders would of been shooting 90 years ago based on their track record.
