I get tired of the security ladies asking if I’m stealing a shotgun or if I’m just happy to see them.
It’s getting harder and harder to steal shotguns these days.

She should have told the employee if he thought she was shoplifting, call the cops. Store employees do not have the legal right to detain customers. Store security is usually pretty good, they will let you walk out the door then stop you, when they do the cops are already on the way. I’ve watched them operate. They have plain clothes in-store security in addition to video cameras covering every inch of the store, and their security is pretty good. I watched them arrest a guy one day with $280 in merchandise, including a boat battery and pair of Nike shoes, all kinds of stuff in every pocket in sight.
In one store I had no choice to go to, nothing else in town, they insisted on trying to make me show a receipt when I lefty the store every time. I refused, told them if they thought I was shoplifting, call the police, and to be damn sure they were right. They never called the police and I never showed anyone a receipt. I told their door guys several times where Wal Mart could stick their guilty until proven innocent mentality. I started putting my receipt in my pocket when one guy tried to reach into my shopping bag and take it. He has no idea how close he was to me deciding to defend myself...he did get his hand slapped. You better not TOUCH my property bud...he decided to back off..
If they think you are shoplifting, do not show them a receipt, do not prove you are not, it’s their responsibility to prove you are, until you get into court. Insist they call the police. When it turns out you’re clean, it’s lawsuit time. Especially if they try to search you without probable cause. Only allow the police to conduct a search. If they detain you without reason, attempt an illegal search, stop you from leaving the store, demand they call police.
I don’t go to wally world, my sister worked there for about 6 or 7 years, I know what a rotten company they are to work for. My whole family won’t go near a wally world store. I only went to the one because there was nothing else in town. Not even a decent grocery store. Wally World and Dollar General, that’s about the choices.
They know, they’ve been sued before, if they accuse you of shoplifting and bring in the police, it’s bad news if you’re clean. They will almost always back down because they know the lawsuit is on your side if you are not shoplifting and they detain you anyway. Demand they call police if they try anything like this. Just tell them if you think I’m shoplifting, call the police.
They most likely won’t do it, I already know if they do think you’re shoplifting, store security will stop you, not some peon at the door, they will have video of it, and police will already be on the way. And store security will let you walk outside, because until you walk out the door, it’s not stolen yet. They’ve lost that lawsuit too.

Most of your points well taken. She was “searched” based on the incorrect premise she was a shoplifter. Perhaps if the “search” was conducted by some designated security person, then yes, I agree with you. But that was not the case. To accuse a customer of shoplifting and being wrong, is actionable, IMHO, even if she complies. I still think she has a case, however nominal the damages may be.
