ALBANY, N.Y. (AP) â Drunken-driving charges against an upstate New York woman have been dismissed based on an unusual defense: Her body is a brewery.
The woman was arrested while driving with a blood-alcohol level more than four times the legal limit. She then discovered she has a rare condition called âauto-brewery syndrome,â in which her digestive system converts ordinary food into alcohol, her lawyer Joseph Marusak said in interviews this week.
A town judge in the Buffalo suburb of Hamburg dismissed the drunken-driving charges this month after Marusak presented a doctorâs research showing the woman had the previously undiagnosed condition in which high levels of yeast in her intestines fermented high-carbohydrate foods into alcohol.

I would guess she could do a yeast cleanse. Not good to have so much yeast in your body it brews stuff into alcohol.
Pardon me but is that some sort of yeast infection thang ?
I’ve heard of this. Think I read about some guy with this condition.
And I’m pretty sure that I read about it on FR.
Reminds me of the affluenza case in Texas. Perfect case of where one fool lawyer meets up with one fool judge in court.
Would she be drunk all the time?
It is a real condition. Her driver’s license should be suspended until she can have it successfully treated, or revoked if it cannot be treated.
Or ball all day?
I believe that’s actually “a thing”.
If this is true, she shouldn’t have a driver’s license.
Not on Atkins.
She may have won this round, but everywhere she goes she is going to need to get licensed as a brewery and zoned accordingly. If they want, they can ruin her life over this.
I read the article and they said she is now on a low carb diet that controls the disease. So Adkins would certainly do it.
A new definition of self medication.
Is it contagious? If so, what’s her address?
This was a plot on a police detective TV show from, I don’t know, maybe 50 years ago. I emembe seeing this and thinking, “If this is true, this guy (it was a guy in the story) needs to stop driving until he gets his internal bubbly process stopped.”
Cheap date.
Hey, hey what can she do?
And with a BAC of four times the leagl limit, they probably post here on FR :P
They’re not just meeting for the first time in court. They’re usually buddies, and the judge may even be helping the lawyer come up with something that can seemingly justify throwing the case out.
