Twin Peaks lawyer: Stop legal chaos, start biker trials today (UPDATE)[Waco]

A Houston lawyer, representing a biker charged in the Twin Peaks clash, traveled to Waco Monday with a bold offer that might be too intriguing for a judge not to indulge him.

The plan, described in a motion filed in McLennan County, stands to save the 105 other defendants as well as prosecutors, police, and dozens of other lawyers and courthouse personnel from a massive, expensive legal boondoggle.

As lawyer Paul Looney sees it, there is no way the county can handle the cost, time and logistics of prosecuting 106, and maybe more bikers, especially if most of them refuse plea agreements and demand trials.

Even if the county held a trial a week _ week in and week out without a break _ it would be about two years before all would be resolved, he said.

Instead, Looney holds out his client, who he said is ready to stand trial immediately without a change of venue or any more evidence, and serve as a test case for everyone on all sides of a melee that left nine people dead and at least 18 wounded.

I don't know if Looney got a ruling on his motion.

I don't know if a single trial date has been set.

I don't know if Broden is ever going to get a ruling on his challenge of the gag order.

I don't know why AP is still sitting on those thousands of pages and the videos that they obtained.

I don't know how far down the road Reyna can kick the can.

There's a LOT I don't know. But, there is even more that I suspect.

Good legal strategy for the defense. Clearly some of the bikers are guilty of nothing but being in the wrong place at the wrong time. Undoubtedly the defense picked the most innocent defendant they could find for a test case.

The prosecution should agree on a test case but should insist on picking which defendant that they will try first.

There is a huge problem with that.

For a test case to go to trial (even with someone actually guilty of shooting someone and initiating all the hoopla) the prosecution has to release all the information to the defense that they were required to have released weeks ago.

So far the prosecution is unwilling to release that information.

Even though they are breaking Texas law by withholding it.

Trials will be a waste of time, they should be dispensed with. The State of Texas has already decided that members of criminal gangs are engaged in conspiracy to commit crimes, and no doubt that a crime occurred at the Twin Peaks Restaurant. Therefore, they are all guilty and they should all be sent to prison for life. Besides, it’s really hard to find out who committed the murderers, so why bother?

These people went to Twin Peaks to commit a crime, we don’t need any evidence, the cops knew what was going to happen, so all they needed was to round everybody up. They’ve done their job. If those people didn’t want to spend their life in prison, they should have gone to church, not to the restaurant. Most of these people are white, this will be a remedy for the racist courts that send only Blacks to prison. This will show that the District Attorney is a tough guy who is working to keep the community safe.

If someone decides that there has to be a trial, then build cages in the courtroom for all of the defendants and tell them to select one attorney to represent all of the defendants. The evidence can be presented in the morning, defense case right after lunch, jury deliberations in the afternoon, and verdict by quitting time. This should be that hard, the State of Texas has already made a law to send all members of motorcycle clubs to prison, so let’s get on with it.

Looney filed a motion seeking the earliest trial setting possible for Ledbetter. He also filed a motion to quash the indictment. A hearing on that motion is set for Jan. 8.

Twin Peaks indictments list 10th dead biker - WacoTrib.com - December 17, 2015

Reyna is resisting setting trial dates. A setting for May was rescinded by the judge who set it.

I haven't seen any evidence that Broden has filed paperwork in federal court, to stop the state prosecution. He said (to a state judge, in open court) he was going to do that.

Reyna can kick the can an easy year or two. The only decision that is apt to run against him in that time is the gag order.

I think you’re right. Reyna obviously didn’t think this through. Now he has put his office, basically everyone on his side in a no-win situation. Even if he drops everything, they are screwed. You know at least a couple dozen of the people he charged would come back at him personally and his office for wrongful prosecution. He wasn’t able to intimidate and bluster his way to a plea agreements. He is trapped by a really stupid, just flat out stupid legal strategy.

Huh?

There is no monolithic “the defense”.

The lawyer that is proposing this action is doing so on behalf of his CLIENT. That’s singular “client”. One.

It’s the persecution that is a monolithic and corrupt herd of rat bastards.

Not sure that this is driven at the state level.
It smells like Wacko, through and through.
