What a dumbass; that’s the same reason you don’t sleep under coconut trees in the South Pacific.
But unless the tree is native to the area, how would that man be expected to know about such a thing? IMHO, no fence is necessary around such a tree. But there should have been a couple of warning signs near the tree. . . .

Maybe a warning sign would have been nice but, what idiot put a park bench under a tree that drops 40 pound seeds. Because of the location of the bench there is no doubt the city made a mistake and will loose in court.
He should be thankful it was a pinecone and not the dreaded Australian Drop Bear.
He’d be dead in that case...
