A US Court Threw Out VirnetX's $368 Million Patent Infringement Award Against Apple

A federal appeals court on Tuesday threw out a jury order requiring Apple Inc to pay VirnetX Holding Corp $368.2 million in damages for infringing four patents concerning technology for providing security over the Internet.

Shares of VirnetX plunged as much as 59.8 percent after the decision by the U.S. Federal Circuit Court of Appeals in Washington. The company and its lawyer did not immediately respond to requests for comment.

Apple had appealed a November 2012 jury finding that it infringed VirnetX's patents for virtual private network, or VPN, technology through the FaceTime feature on its iPhone, iPod Touch and iPad products, as well as on its Mac computers.

While agreeing that some patents were infringed, the appeals court said the verdict was tainted by incorrect jury instructions from the trial judge on how to calculate damages, and that the error was not harmless.

Guilty of the charge, "biased" in the punishment phase...

********** Not that I have any Apple love but this VirnetX is scummy slimy bottom feeders AKA lawyers that buy up patents with an eye to suing. IOW they are useless eaters and no one whould miss them if they all dropped dead. Not even their mothers...

Since 2012 VirnetX has been suing companies including Apple, Cisco, and Microsoft,[1] and has previously sued and won a jury trial and settled with Microsoft, and sued and settled with Aastra, Mitel, NEC, and Siemens, and most recently Avaya.[citation needed] In their Apple case, VirnetX worked together with SAIC,[2] and was awarded $368 million in damages for FaceTime infringement.[3] That ruling was overturned on 8/19/2014[4] by the UNITED STATES COURT OF APPEALS FOR THE FEDERAL CIRCUIT [5]. Currently, VirnetX has over 80 internet security patents worldwide.[6]
