On the one hand, this means there are 2 less criminals running around mugging people. However, the man did actually commit double homicide—he killed two men, which is the definition of double homicide. The question is whether it was justifiable homicide or not. At least based on the “facts” presented by the new report, it was not justifiable homicide since the carjackers were in the process of fleeing the scene, meaning that the threat to the citizen had passed.

Is it possible that there were extenuating circumstances that would have given him justification for chasing them down? Yes. Maybe they stole his wallet and keys and said something about breaking into his home and hurting his family. Maybe they gave him reason to believe that they would carjack someone else that night and hurt them. Maybe he has a basis for a temporary insanity plea due to the trauma of being attacked and almost carjacked—”I just lost my mind, officer! I didn’t know what I was doing!”

Any of those and more are possibilities, but we can’t know for certain without more facts.

According to census data, Wakefield is primarily black, 73% and 19% hispanic so the Mercedes guy is probably not white.

Those were my thoughts too. A white guy is not screwing around at 4AM on Dyer Ave in the Bronx. Going by the odds....

“Chasing them down” is merely circumstantial evidence that COULD be indicative of an intent to murder if corroborated by other evidence. He could argue that his intent was to recover his property and in the course of that attempt his life was threatened by two armed carjackers who had previously offered an assault with deadly weapons to successfully carjack him, and then attempted to kill him as he attempted to get his property back, resulting in his justifiable use of deadly force so has to protect his life..

I am a retired State Policeman with 28 years on the job, and it ain’t NEVER a sure thing when you have 12 people on a jury and the circumstances are ambiguous. At worst I see this reduced as voluntary manslaughter or another similar charge.

In just about every legal jurisdiction, murder is defined roughly as the unlawful killing of a human being with PREMEDITATION and some sort of “malice aforethought.”

Chasing someone down is NEVER evidence of murder by itself, but IS an element or circumstance for cosideration at ajudication or analysis by prosecuters as to the state of mind of the accused.
