Letter attacking boy with autism not a hate crime, police say

A devastating letter sent to the family of a teen with autism is hateful, but not a hate crime, police say.

“Despite the hateful language used, the Crown Attorney’s office has advised that the content of the letter falls below the threshold for a hate crime,” Durham Region police said in a statement Tuesday. “However, there are other Criminal Code issues that are being considered.”

The criminal code defines hate propaganda as a statement that advocates genocide, publicly incites hatred, or wilfully promotes hatred.

Although the message in the anonymous letter has been spread widely by concerned family and friends, the fact that the offensive screed was addressed to one specific family makes it an improbable hate crime charge, lawyers say.

“If you can’t show that someone has published broadly, then are they really trying to promote hatred or are they just being a nuisance to the poor parents?” said lawyer Philip Tunley, speaking generally, and not about specific facts of the case. “It’s a tough one, but that’s the kind of thing a Crown attorney would look at.”

On Friday, Brenda Millson, the grandmother of 13-year-old Maxwell Begley, received a letter in the mail at her Newcastle home. The anonymous writer, who claims to live in the neighbourhood, complained about the noises the teen makes when outside and wrote that the teen was a “hindrance to everyone.”

I have a child with autism. Three boys at his high school created a Facebook page about how they wanted to torture and kill him. Very descriptive. Other kids chimed in. “Tie him to a tree and light him on fire and listen to his screams.”

The police reaction? Boys will be boys!

I went to each parent’s home and told them I would beat the living hell out of the father unless the Facebook page was removed and all kids apologized.

The police came by and said that was assault.

Can you believe it?

However, if the autistic son’s parents can allude to the possibility that their son might possibly become queer, black or Progressive in the future, they will reconsider the hate crime charges.

Facebook still permits the pages up that urge the hatred and murder of George Zimmerman.

FB does not have “software that detects” death threats, racists slurs, etc. They have Stalinists who delete certain pages and posts based on political whim.

It is not a hate crime. On the other hand, the person who wrote it is a very hateful person. Sadly, we no longer are a Christian nation; in a National Socialist society the weak are removed “for the greater good.” There are no group rights in the Constitution. Yet you will note the government creates group rights to gain voting blocks. Autistic people are not a big enough identifiable group with resources to make a good voting block for them. Thus, autistic people are a drag on a National Socialist society and need to be eliminated. That is the way it was the last time National Socialism was on the rise.

Some animals are more equal than others (the core of liberal philosophy). If the same comments were made about a gay or black student, it would be a "hate crime", but not for Autism until families dealing with Autism march lockstep with the Democrats and vote as a block. I prefer the moral alternative - don't bully anyone, treat all kids politely and with respect, and deal appropriately and firmly with parents who allow bullying of any kind.

I can believe it. Yes, go ahead and talk to the parents, but the most effective thing to do would have been to call Facebook. I got a Facebook page pulled down in one day. Use all the right catch words: lawyers, lawsuit, bad publicity, legal action, writing letters and emails to newspapers, congressmen, and organizations that protect the disabled, etc.

There’s no such thing.

Things are a crime or they’re not.

Beyond establishing a motive it doesn’t matter how the perpetrator felt about the victim.

The police only knows how to issue traffic tickets. To go to their homes was a bad idea. Contact media and give the names of the parents. I’m sure that one of the local stations ,hungry for news, will do that. Make sure to print out copies from Facebook page, police report. If you can afford few hundred extra dollars, have an attorney send letters to parents, police dept. and Facebook indicating that, if God forbid, something happens to your child, all of them will held criminally responsible. It will work. Been there, done that.
