Judge dismisses case against cop who broke into home with no warrant & killed unarmed man

THE BRONX, NYC, NY -- After a year of public outrage and legal proceedings, a judge has simply thrown out the indictment of Officer Richard Haste, who gunned down an unarmed man inside his own home, without a warrant. Haste was facing manslaughter charges until the judge tossed the indictment.

In February 2012, police broke into the home of 18-year-old Ramarley Graham without a warrant, did not announce themselves as police, shoved guns in the faces of the residents and ultimately gunned down Graham for no reason.

This was a buy-and-bust that had the deceased running from the police. No warrant was needed because the entry was part of the hot pursuit of the suspect. Odds are, the suspect made a sudden movement to flush the evidence, and the cop mistook it for an attempt to draw a firearm.

The tragic chain of events began when police pursued Ramarley Graham into his family’s Williamsbridge apartment as part of a drug deal investigation.

Once inside, Haste identified himself as a cop and fired at Graham point-blank in the bathroom after mistakenly believing he saw a gun, police officials said.

Cops found a bag of marijuana near Graham’s body and suspected he was trying to flush it down the toilet. No weapon was found.

The ruling Wednesday reignited the widespread anger over the incident. “This is an outrageous miscarriage of justice and an insult to the family and supporters of Ramarley Graham,” said the Rev. Al Sharpton.


The moral of this incident is that drug dealers should not make any sudden movements while being challenged by a cop.

Killing someone for selling drugs? Right.

Not the first time someone's been killed for making a sudden movement at point blank range. If the deceased had produced a gun and the cop had hesitated, the funeral might have been the cop's. The way for drug dealers to avoid such misunderstandings is to remain motionless when cops are within several yards trying to arrest them.

Thought a baggie of weed was a gun? If a civilian made that mistake (if that is what is was) how many years would they be doing now?

The arrival of Sharpton and his "supporters" is a certain indicator there's money to be stolen, lies to be told, racial hatred to be spread, or all the above.

There is no evidence that the unarmed 18 year old who was shot to death in his own apartment was a 'drug dealer'. Even the article you cite doesn't claim this. The only evidence reported is that a 'bag of marijuana' (no mention of amount) was found near the victim. The only real moral here is that in the US today, cops can break into your home at will without a legal warrant or invitation, claim you are menacing them, and shoot you - and can then find people willing to blame you for having the nerve to get killed by the cops for the crime of standing in your own bathroom holding a bag of weed.

The case was apparently thrown out due to a DA's mistake and will apparently be re-submitted to a grand jury. I sincerely hope so.

The one thing here that bothers me is this LEO’s explanation of ‘looked like he had a gun’ is a person’s normal posture when flushing a toilet from a standing position. Most people have to bend over.

I’ve never seen in the movies where a perp with a gun bends over like one would do flushing a toilet to even ‘get a gun’ from his rear pocket, say.

The other thing is that if this perp did exactly that, then he wasn’t ‘waving’ a gun at the cop, already.

This cop needs to be retried.

That headline doesn’t tell the whole story. The police officer had information that the drug dealer was armed. The dealer fled into the apt. and was attempting to get rid of the drugs when he turned on the officer and was shot. One druggie dead that won’t get more kids hooked.

Breaking down a door without a warrant, not announcing they were the police, gunning down an unarmed man...all for a bag of pot...Really ?

Why didn't the police detain him before he went into his house? Obviously they were watching him...

I have no problem with the death penalty for drug dealers who illegally sell Schedule III drugs...

Once I read Al Sharpton, being involved on the perps side....the judge made a good decision

Sharpton is Black Ku Klux Klan Racist...and him bringing in the New Black Panthers (Black Ku Klux Klan) trying to lynch George Zimmerman after his self-defense capping of Trayvon Martin, should tell everyone nothing good comes around with Sharpton
