She could be charged, but has a female ever been charged with assault for such an action, in the entire history of the United States. I doubt it. Any man that has a woman charged for assault for dumping a drink on him (for his being a rude, ignorant jerk) should remove his testicles and send his manhood card back to the men's union.

The law removes that choice. She did it in front of witnesses. If the prosecutors want to send a message, his consent is not required.
