A boy of 12 who carried out more than 20 criminal acts was today released without charge - because the courts have no legal way to deal with him.
A judge heard the child's behaviour has 'deteriorated beyond control' but his low IQ means that he cannot properly understand the court process.
The judge described the situation as the 'perfect storm' as there is no way that the court could accept a guilty plea from him, as he cannot understand the implications of his acts, and they could not follow doctor's recommendations, as the boy had not been convicted.
The boy initally entered 22 guilty pleas in July for offences including sexual assault, racially aggravated assault, theft, common assault and criminal damage.
The case has since been back before the courts 15 times in a bid to find a way to deal with the boy, who is originally from Portsmouth, Hanmpshire.
But psychiatric and psychologists' reports established the youngster - who is now in foster care - has an IQ of just 58.
That puts him in the bottom three per cent for his age and unable to understand the implications of his acts.
Because of the reports, district judge Anthony Callaway allowed new, not guilty pleas to be entered for all the charges under common law powers. Making a finding of fact, district judge Callaway found the boy had committed the acts around Portsmouth city centre, mostly in May and June.
But because the boy could not participate in any meaningful way in court proceedings, he could not be found guilty.

With an IQ of 58 I see a career in Congress in his future.
At an IQ of 58, he’d still have enough intelligence to seek out his instinctual desires, just not enough intelligence to know how to restrain himself or empathize with his victims.
He’d be in an institution, but the liberals closed those. So, he will have to be taken care of when he breaks into somebody’s home.
I don’t know if liberals in England shut down mental asylums. This is not American.
I’ve always heard that ignorance of the law is no excuse. This little monster will destroy many more lives until someone “deals” with the situation. I’m tired of hearing of these “Disturbed” kids that don’t get help and constantly get released by the courts. Then people cry about how could this happen....
Empathy and constraint aren't that closely linked to intelligence. I've never in my life seen a person with Downs Syndrome that wasn't empathetic. Meanwhile, highly intelligent people who lack empathy are the most deadly psychopaths.
We are agree on the need to institutionalize such persons.
I’m sure he was easy to catch as he didn’t know to cover his trail. He probably did the deeds in the daylight in front of anyone who was around.
As a psychological examiner, I tested a young man for Texas Rehab. who was just out of prison for stealing car tires from a service station. He had a low IQ, which is why he tried to steal the tires out in the daylight in the middle of the day. He didn’t have enough intelligence to try to hide his deed from anyone. I doubt he knew he was stealing.
This is a catch 22 for people with low IQs. If they don’t have a family member who takes care of them, feeds them properly and knows where they are at all times, anything can happen.
At the risk of receiving the ire of everyone here, there was a time when such things were dealt with.

Yes most of the asylums where shut down.
This occurred during the 80's and early 90's.
Only the very worst or new cases are held in asylums for any period of time.

As a result tens of thousands of new care jobs were created to 'help out', and make the mess work.

He’s not an American, so he wouldn’t be eligible to run for Congress. Hmmm, for what federal office could a foreign born idiot with an IQ of 58 run?
He can not be held legally responsible with a conviction because he doesn't have the mental capacity to aid in his own defense.
with his low IQ a good dose of adolescent testosterone and he becomes a walking hormone with no internal controls at all.
This is a very sad situation and the only real answer is a life of institutionalization. I do not know if the British system, or any system is set up to care properly for this type of person.
Hmmmmm if at the time of an offense we can spank our dogs with a rolled up newspaper, and make the dog understand good from bad, right from wrong, and if we can rub their noses in their bad, and make the animal, the pet understand not to do THAT again where the animal, the pet did it, then how can it be this kid with an IQ above that of an animal cannot be taught right from wrong, etc?
Must be a bunch of Liberals trying to figure out what to do with this kid, because anybody with sense would know what to do.
Then there is the Arab option: Strap a suicide vest on the person. Tell him/her to walk over to x, then blow them up at a convenient time.
they kid here is not stubborn just stupid. Literally. 58 on the IQ? I am surprised he can tie his own shoes.
They did not have institutions back then but they had a way of dealing with crazies or out of control people. Usually tied them to a tree or something.
FReepers are correct he needs in an institution.
Once he becomes a serious danger to others ,or more likely seriously harmed or killed ,there are special prisons for the mentally unstable.

There are some great requirements in this law: Mom and Dad both have to bring the kid forward after trying to discipline him. All of the men must take part in his death.

It could be summed up as “don’t be a dick and you won’t get killed.”
Poison his jail food, see if he can comprehend the meaning of that act.
