Operating an ObamaCare ‘Exchange’ Would Violate Ohio’s Constitution

Unconfirmed reports indicate Ohio officials are considering implementation of an ObamaCare health insurance “exchange.” That would be very interesting if true, because operating an ObamaCare exchange would violate the state’s constitution.

Section 21 of the Ohio Constitution provides:

No federal, state, or local law or rule shall compel, directly or indirectly, any person, employer, or health care provider to participate in a health care system…

“Compel” includes the levying of penalties or fines.

13 other states have passed statutes or constitutional amendments (Alabama, Arizona, Georgia, Idaho, Indiana, Kansas, Louisiana, Missouri, Montana, Oklahoma, Tennessee, Utah, and Virginia) that bar state employees from carrying out these essential functions of an ObamaCare exchange.

NOTE: As time goes by, I wonder how many more states will adopt such laws?

CONSTITUTION ,,,, what’s that ? ,,, With the 0bama justice dept. I see no problem with disregarding any State or US Constitution . The frog is getting very hot and hasn’t budged a muscle . We are sheeple .

Seems a State Constitutional provision should trump a Federal law.

Sort of like a straight flush vs. 4-of-a-kind...

You’re a little nuts with your use of punctuation.

What will I do? I guess that remains to be seen. i guess the first step in resisting an encroaching tyranny, like Obamacare, is to identify it and point it out to others. Maybe vote. Maybe resist it at every turn.

I will not participate in a healthcare scheme that requires me to do so involuntarily. I will not participate, answer questions, complete forms, or acknowledge it as anything legitimate under our form of government.

As this turd of a bill flowers and spreads, others will begin to see it for what it is. Then and only then will it die.

And hey, at least my state sought to nullify Obamacare — See Thomas Jefferson on nullification by the states.

Be part of the solution instead of someone on the sidelines with spitballs and a straw.

I hope it works for you ,,, I really mean that ,, my current fear is that the constitution is irrelivent now . No brain Boehner and the rest of our spineless congressmen allow 0bama to rule by fiat and executive order now ,,, congress is useless IMO . My belief is that it will require a lot more than just the 1st ,, 2nd and 10th amendments . The Bill of Rights and the Constitution are crumbling right before our eyes . You have a great Governor ,,, and I have great respect for him . I ,, on the other hand live in the bananna republic of Maryland where there is little hope now . The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

Keep messing with the states and they can open up a significant can of whoop-ass on the federal government.

Especially when you have 30 Republican governors....

The Constitution saw these circumstances and allowed for them.
