Looks like it's time to ask, "Who has the authority to suspend the presidential election?"
I would see no one since they are actually 50 separate elections that are controlled by each state.
SCOTUS comes to mind.
No one. Presidential elections have been held during wars (1864, 1944), and they were not suspended.
MY question is who has the authority to ARREST the president for high treason?
I thought you were going to ask if it was time for FReepers to start a new board.
I would say nobody, except maybe individual State election commissioners or Secretaries of State.
Article II, Sec 1: ...Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors...
Obama could say he suspends the elections all he wants but if say Ben Ysursa Sec of State Idaho says we’re still having an election then Idaho’s 4 electoral votes are going to Romney whether Obama likes it or not.

As a matter of fact I am not sure how they can constitutionally hold early voting. I think that could be successfully challenged in court. Where in the Constitution does it state that you can vote two months or even two days before the first Tuesday after the First Monday in November?
Nobody really.
Any presumed authority would be highly conditional and subject to extreme circumstances.
For instance:
One candidate dies, and the other agrees to a postponement.
Country comes under attack.
Major disaster in large swing state.
You should find a more productive area of speculation, because it won’t be due to Obama’s fear that he’s losing, and decides he’ll make a declaration.
How do you do that with your posts?
Doesn’t mean it can’t happen, just hasn’t happened yet.
I do not believe there is any provision to cancel an election. I suspect the Congress - both houses - with Presidental signature on the bill could cancel or delay the election in case of National Emergency....like Obama gonna lose I suppose. But of course that would then be immediately appealed to the SCOTUS for emergency hearing and they would almost have to hear the arguments...of course, with Wishy-Washy Roberts in charge I’d be afraid of that decision.
Then again suspending the constitution is not beyond the Usuper-in-Chief with no member of Congress having the fortitude to hold him to it!
and that legislature could vote tomorrow and say they will appoint elecotrs instead of people voting for them..
That’s what my advisor told me. However, the current POTUS—oh, well, I dunno. I just wanted to seek opinions from the collective wisdom here.
Ok....I’ll bite
Why is it time to ask?
Libya?
Fast and furious?
Treasonous deal with Iran?
Only one man has that power...
That is a very good question.
The people would never roll over for a presidential election getting “suspended” for any reason that wasn’t crystal clear and demonstrably obvious. It has never happened and likely never will happen.
The only conceivable circumstance I can think of that could possible prompt the suspension of an election would be some kind of coordinated election day scheme of multiple acts of terror resulting in mass casualties. In that case an election might get suspended for up to a week.
Why do you ask?
