House raid ends with no drugs or arrests, but police say they were on target
Chicago Tribune ^ | October 10, 2012 | Robert McCoppin

Paul Brown was working on his computer in his north suburban home when police smashed in the front door, pointed guns at and handcuffed him and other family members, and ransacked the house in a search for drugs.

The authorities had burst in immediately after a postal worker delivered a package to the home that they said contained marijuana. But a search of the house found no further contraband, and officers left without making an arrest.

Brown, outraged, said he was sure the cops had the wrong house. Police maintained they had the right place, but the target of their investigation wasn’t there at the time.

Brown, a 58-year-old who works in building design, said he supports law enforcement in general. But he said innocent bystanders shouldn’t be subject to such dangerous and damaging searches without any compensation.

“I was scared to death,” he said. “I really felt like a hostage. These guys are supposed to be on my side.”

The package delivered to the home in a middle-class neighborhood on Adelphi Avenue was addressed to someone named Oscar, who Brown said has never lived there and is unknown to him.

Brown would have liked police to pay for the $3,000 leaded-and-stained-glass door, lock and frame they broke, to clean up the mess they made, and to apologize. Police say that won’t happen.

Get a nasty-faced lawyer.
They’ll change their tune.

Gawd. I’m thinking these off-target, damaging, often fatal to pets, occasionally fatal to innocent citizens no-knock raids will continue right up until a Senator gets killed in one. And then those in power will take notice.

Seems like they could knock first, and then smash the door in.

In the absense of a knock, they should have to replace the door and frame. Plus something extra for his trouble.

I would be on the phone with a lawyer about now.

"officers knocked on the door and announced themselves, and waited an unspecified "reasonable" amount of time, as required by law before breaching the door, Sullivan said."

Beware of increasing installations of front porch IEDs.

Make it a crime to enter raid a house “by mistake.” Mandatory sentencing.

““I understand when you walk away (without an arrest), that brings up a lot of questions,” Sullivan said. “But there’s a series of checks and balances … to make sure we’re doing everything right. We are concerned about the public as much as they are about themselves.””

Translation: We can bust down whatever doors we want, terrify private citizens, including the elderly 77 year old mother-in-law, and refuse to pay for the damage but don’t worry, we said “checks and balances”, so you can go back to sleep, Citizens, this won’t happen AGAIN!” (turns to his men): “Which peasant are we raiding next?”

Here’s a notion: How about they knock, wait at the door with the warrant, and NOT act like King George’s soldiers busting down doors “in the name of the king”.

A small price to pay to defend the nation's Cheetos supply.

Sullivan said police have to enter such raids in a rush with overwhelming force, to prevent people from flushing or destroying evidence

Because having to flush the pot you paid good money for isn't nearly enough punishment.

Some lefties are using “swatting” as a tactic to target their political enemies, make fake reports to police that there is a hostage situation somewhere. So, it may just be a matter of time before that happens.

Indeed. I fear it is only a matter of time before Freepers begin vanities with “The SWAT team just left my house——”

“The MEG unit worked with the U.S. Postal Inspection Service, which provided an investigator to deliver the package, Sullivan said.”

Sweet! So now all the State *thinks* it has to do to “justify” raiding you is to arrange for a “suspicious” package to be delivered before the raid, and voila! Probable cause!

The State is pleased with its resourcefulness of its Knights of the realm and Other Employees, Citizens!

I’m surprised they didn’t shoot the family dog as long as they were there.

It already *is* a crime to illegally enter a home.

Laws don’t stop criminals.

Apparently they were satisfied that the “peasants” within were sufficiently cowed and awed by the Knights in their presence without that measure.

We live in the effing Soviet Union! We could have saved the Russians a lot of trouble by surrendering 50 years ago, instead of now.

Not gonna happen. Caus’right after they shoot the family dog handcuff mom, dad and all the kids and force Grandma to the floor with her broken hip, they will confiscate the puter.
