Justices Ruth Bader Ginsburg and Stephen Breyer should soon retire. That would be the responsible thing for them to do. Both have served with distinction on the Supreme Court for a substantial period of time; Ginsburg for almost 18 years, Breyer for 17. Both are unlikely to be able to outlast a two-term Republican presidential administration, should one supersede the Obama administration following the 2012 election. What's more, both are, well, old: Ginsburg is now 78, the senior sitting justice. Breyer is 72.

Works for me. Then bottle up the replacements in the Senate till after Jan.
Either way, a president that makes a habit of appointing LIBERALS to the bench will be in power in 2013, so the might as well stick around.
I wish them good health for at least 5 more years.
Bad idea....bad timing, they need to wait awhile. I think that they know that also.
It’s CBS news. They want Obama to replace them.
“I wish them good health for at least 5 more years.”
Agreed...
They just want The One to be able to put two more young extremely leftist liberals on the SCOTUS now as he will lose in November.
I am hardly a Romney fan, but even I don’t believe their choices would be the same. I just don’t. Consider a 2nd term marxist who doesn’t have to give two sh1ts about ANYTHING or ANYONE and his picks, versus Romney’s potential picks, and you can damn well bet he will care about getting re-elected again.
“Both have served with distinction on the Supreme Court for a substantial period of time”
With the distinction of being the two worst justices on the court until Obama started appointing.
Probably not exactly true, but it was the first thought that came to mind. Served with distinction my @$$.
Because partisan politics should always be the prime consideration for the court.
*sigh*
In spite of her age and poor health, Justice Ginsburg “hangs on”. Why is that?
A hard leftist she may be, but she is also a Jew. I believe that notwithstanding her political leanings, she sees Obama for what he is, a Muslim sympathizer at the least, or an outright Muslim, period. As a Jew, I sense she will not provide a him the opportunity or satisfaction of filling “her seat”. I sense that, deep down, she despises him, and is determined to outlast him...
I could be completely wrong, but that’s how I see it...
You smell that? ... It smells like fear.
They will retire if Obama loses. Then Harry Reid will put replacements through in a lame duck session. The Republicans will cry about procedures, but cave as always.
It does doesn’t it? Rats are lingering near the life boats.
Dear Randall,
Ginsberg and Breyer are liberals.
They’ve never done anything “responsible” in their life.
What makes you think they’re likely to start now?
Actually, the GOP should start now to refuse to nominate any Obama court appointees to any court: federal district, appellate, and Supreme Court included. Then go all-out to keep the House and win the Senate in this year’s election (and hopefully the White House as well, but I expect Romney to nominate a lot of sterling GOP judges cast from the same mold as Souter and Stephens). If the GOP then controls both houses, it should decrease the size of the SCOTUS every time a liberal justice retires or goes toes up.
And we need to impeach Kagan for participating in the ObamaCare decision.
Do you have any facts to back up your feeling that Ginsburg as a Jew distrusts the muslim in the WH?
I wish that it were true but there are still many many Jews supporting the muslim. Jews are frequently so smart but they have such a huge blind spot when it comes to liberalism.
Refuse to CONFIRM, not “nominate”. Let Zero nominate until he’s blue in the face, just don’t confirm any further nominations at any court level.
Of course, the GOP’s problem with such a strategy would as always be with senators of the likes of McCain, Graham, Brown, and the nitwits from Maine.
...2017.
It wouldn’t surprise me to learn that most SC Judges are not happy with our current administration.
Reportedly, she is Justice Scalia's best buddy on the Court:
I consider myself a good friend of every one of my colleagues, both past and present, Scalia told Laura [Ingraham]. Some more than others. My best friend on the Court is and has been for many years, Ruth Ginsburg. Her basic approach is not mine, but shes a lovely person and a good loyal friend.
I wonder what she thought when Scalia joked that ordering his clerks to read the Obamacare law would violate the Eighth Amendment.
I have written almost the same identical post as Road Glide before. Ginsberg has had Pancreatic cancer for a couple of years or so now. My father died of it and it’s considered one of the worst, most painful of all.
So, I’ve wondered for a long time how she could manage to hold out, why she didn’t retire, etc, and the conclusion I also came to is that, in spite of her liberal views, she ‘knows’ what Obama is and is waiting him out.
Romney or Obama. Not really a choice here. Romney is not as far to the left as Obama though. In any case both will appoint liberals to the bench, you can bank on it.
“A hard leftist [Justice Ginsburg] may be, but she is also a Jew. I believe that notwithstanding her political leanings, she sees Obama for what he is, a Muslim sympathizer at the least, or an outright Muslim, period. As a Jew, I sense she will not provide a him the opportunity or satisfaction of filling her seat. I sense that, deep down, she despises him, and is determined to outlast him...”
The rumors of a 7-2 beatdown of Obamacare must be true then.
CBS has the long knives out.
I wouldn’t be surprised. Good analysis
Oh yeah? And let the imam stick Eric Holder of WACO fame in there?
The irony of asking for facts while asserting Obama is a Muslim is lost on you.
Translation:
CBS to Obama:
PLEASE REPLACE THESE OLD FARTS WHILE YOU CAN AND DON’T LET ROMNEY PUT IN RINOS!
It is actually a brilliant strategy and the Democrats would be wise to do this. They control the Senate today and may not control it next year. At the same time, can’t these old SCOTUS trolls wait until the 2nd week of November to retire only if Romney wins. I mean, there is plenty of time until Romney’s inauguration for the Senate to railroad through Obama’s next 2 picks, if he fails to be re-elected.
This would be a brilliant thing for the evil democrats to do while Obama is stil president and while they still own the Senate lock, stock and barrel.
You mean to bottle up Obama’s nominees in the DEMOCRAT CONTOLLED Senate where nominations are approved with only 5 1 votes? Like that bottled up?
The time will likely come when good people are going to have to openly declare that the Supreme Court has no authority to issue any rulings contrary to the Constitution, and the fact that a President who holds the Constitution in contempt may appoint justices who do likewise does not mean such rulings have any legitimacy.
If such a time comes, it will be far easier to effectively denounce as illegitimate a ruling penned by Obama-appointed Kagans, than a ruling penned by Romney-appointed Souters.
Oh, my Gosh, that poor woman. I hope she goes quickly without too much suffering.
I did a Google and she first had surgery in 2009. Most only live a year or so, my dad lived for 2 1/2 years, but that was many years ago and they probably have much better detection and meds for it now.

If they don’t retire, check mate is within reach for us.
Breyer isnt really that old, article says 72. Thats just a kid, in SCOTUS terms. But the Democrats have been on the defensive; had we had a good president and a good Senate these past four years, there would have been a clean 6-vote majority in SCOTUS in favor of the founding principles of the nation. Without even counting Kennedy. Assuming the same two justices retired, which is not a given.
But even SCOTUS majorities arent forever; Scalia and Kennedy are Reagans last appointees, and Reagan left office 22 years ago . . .Scalia will stay on while he can, because his influence on the court is important - and Kennedy, because his vote decides all 5-4 cases, must be having a ball.
“I am hardly a Romney fan, but even I dont believe their choices would be the same. I just dont. “
Yea, you’re probably right. Thankfully, Romney’s been pushed VERY HARD to the right, due to our Primary process. It would be tough for him to become a McCain and simply act as if all he said in the Primary was for ‘domestic consumption’. Even Bush-43 got pushed hard by the base, and had to give up on Harriett Myers (thank God) and Amnesty (also thank God).
