Old Joe was naming them not hunting for them...History has proven him right......but it was communists not witches..

Fiji Hill was trying to be clever (and failing) in a not-so-veiled comment alluding to a 'witch hunt'.

As you and HITHL stated, Senator McCarthy has been proven right, his claims validated, and the denigration of his character needs to stop, no matter where it starts, no matter if it's a lame attempt at being funny.

Because ducks float in water, chickens don’t. ...and since witches float in water, they must weigh the same as a duck.
You'll find two schools of thought on that and I'm a graduate of both . . . ;)

chuckles to you, glad you found a good one....one of my son's got a divorce 17 years ago and she is still hassling him...either sex can be a pain in the ass...When you get a good one, its a gift from God...

Love your remark,* most of the days.* I was married 33 years and at times it gets tough...When I got married my mother told me (there will be times that you want to leave, don't do it as those times pass) drinking and abuse are very legit reasons to leave, those times don't pass, But sometimes for guys it the abuse from the wife....too bad for many.

I had a few times when I wanted to leave, I did once, but 20 miles from home the car broke down and I had to call him to fix it...(its funny now, but wasn't then). When he ask me what the hell are you doing out here, I told him I was running away from home...He was a good man...but sometimes a pain and I think there were times he thought the same of me.....He always called himself Saint Harvey. I called him something else......:O)

Sounds like she was charged with NOT being a witch (i.e., a fraud).

But...what if her defense was that she was not a fraud, but indeed a witch, and could prove it. Is this a case of damned if you do, and damned if you don’t?

Misleading headline. The actual Criminal Code offence is, "pretending to exercise witchcraft." The charge is used to handle fortune-telling scams.

In that case she would walk. It is not illegal to engage in witchcraft, but “pretending to exercise witchcraft” is fraud.

More precicely, it is an offence to FRAUDULENTLY PRETEND to practice witchcraft.

Criminal Code, Section 365:

365. Every one who fraudulently
(a) pretends to exercise or to use any kind of witchcraft, sorcery, enchantment or conjuration,

(b) undertakes, for a consideration, to tell fortunes, or

(c) pretends from his skill in or knowledge of an occult or crafty science to discover where or in what manner anything that is supposed to have been stolen or lost may be found,

is guilty of an offence punishable on summary conviction.
Canada divides Criminal Code offences into "indictable" or "Summary conviction" aka "non-indictable", roughly analogous to "felonies" or "misdemeanors"

Note that the gravamen of the offence is fraud:

Criminal code, Section 361:

361. (1) A false pretence is a representation of a matter of fact either present or past, made by words or otherwise, that is known by the person who makes it to be false and that is made with a fraudulent intent to induce the person to whom it is made to act on it.

(2) Exaggerated commendation or depreciation of the quality of anything is not a false pretence unless it is carried to such an extent that it amounts to a fraudulent misrepresentation of fact.

(3) For the purposes of subsection (2), it is a question of fact whether commendation or depreciation amounts to a fraudulent misrepresentation of fact.

The penalty is minor, as is appropriate to a minor offence:

Criminal Code, Section 787

787. (1) Unless otherwise provided by law, everyone who is convicted of an offence punishable on summary conviction is liable to a fine of not more than five thousand dollars or to a term of imprisonment not exceeding six months or to both.

(2) Where the imposition of a fine or the making of an order for the payment of money is authorized by law, but the law does not provide that imprisonment may be imposed in default of payment of the fine or compliance with the order, the court may order that in default of payment of the fine or compliance with the order, as the case may be, the defendant shall be imprisoned for a term not exceeding six months.

While I agree, McCarthy was right, I was more than a little amused to learn that my Revised Standard Version of the Bible was formally listed as a potentially subversive document in USAF manuals. I have never quite gotten around to understanding what the USAF saw subversive in that translation.
