Sen. Boxer breaks Senate rule: Passes Cap&Tax Out of Committee w/o single GOP member in attendance

The Senate Environment and Public Works Committee approved climate change legislation Thursday with no Republicans voting for the bill or even participating in the process.

With Republican boycotting the proceedings, Committee Chairman Barbara Boxer (D-Calif.) relied on a little used interpretation of committee rules to move the legislation. Traditionally, two minority members are required to conduct committee business.

There will come a time - soon I hope - when the republicans will again control the congress, we’ll be sure to remeber her tactic when we repeal the cap and tax.

Is a law passed in violation of House Rules valid? Can it be challenged as unconstitutional on that basis? Any lawyers here have any thoughts on this?

Not going to happen.

The people of this country, even in its last days of freedom, cannot muster the courage to call a communist a communist.

They respond to a nonviolent, but highly hostile takeover with “Tea Parties”.

You think for a second that they will actually fight?

They are sheep. The commies are winning. No one is resisting.

It’s over.

The rest is wondering exactly how it will fall, and whether or not our families will survive it.

I’m convinced. Commies win. We will see the end of the United States of America in our lifetime. Sure, many of the same people will still be here, but the American lifestyle and belief system—FREEDOM—will be just a fond memory, and a constant heartache.

For the rest of your life you will serve politicians and government officials. All the while hoping and praying that they will leave you and yours alone—they won’t.

Your children will spend their entire lives working for, and avoiding the heavy hand of a tyrannical, left-wing government.

The great experiment will end without so much as a peep, or so much as a drop of blood from the “free and the brave”.

Unless something dramatic happens to change our course, we are heading for dark times on this planet.

Excellent questions. If this is really a violation of the Senate rules, the Republicans should appeal to the Parliamentarian of the Senate and ask for a ruling as to the validity of the Committee's action.

Now, hate Boxer as much as you want, but I have a feeling that Boxer got a decision from the Senate Parliamentarian ruling that since the Republicans were boycotting the committee, the Senate rules allowed her to proceed.

Bottom line: If the Republican leadership of the Senate does not file a complaint with the Parliamentarian of the Senate, then Boxer's move was legitimate.

Yes, we’re losing our way again, but I’m really encouraged by how many common people are waking up to it.

By the way, the reason Europe is further ahead than we are is because of their parliamentary form of government. There are fewer checks and balances in that system. In a parliamentary system, by design the legislative branch and the executive are from the same party (or coalition). Therefore the agenda of whoever is in power sails right through. It just so happens that right now in the US we have potentially a similar situation (with the president and a filibuster-proof congress of the same party), but this is quite rare in the US.

If we manage to regain control of the house, or gain a few senate seats so it’s not filibuster proof, it will stop Obama’s agenda dead in it’s track.
