Man pleads guilty to raping preteen girl

A Spotsylvania man yesterday admitted that he raped a preteen girl earlier this year.
Richard Eugene Smith Jr., 38, pleaded guilty to rape in Spotsylvania Circuit Court. He faces the possibility of life in prison when he is sentenced Dec. 2.
As part of a plea agreement, prosecutor Amy Harper dropped a second rape charge against Smith.
According to the evidence presented by Harper, Smith had sexual relations with the 12-year-old girl twice between June 1 and July 22.
The second incident ended when the girl's mother walked into the child's bedroom and saw Smith molesting her daughter.

Smith left the home, but deputies found him a short time later. He told police that he made a "stupid mistake" and that the child started the incident by "coming on" to him....

It should have ended there. If I were on a jury, I could not vote to convict a mother for shooting a child rapist in the back of the head for raping/molesting her daughter.

While the article indicates that this sick beast faces the possibility of life in prison, does anyone really expect that to happen?
I think it will be punishment enough to send him to France for 30 years to live in luxury. Plus, deny him the right to attend the Acadamy Awards ceremony, even if he wins! That will teach him a lesson!

Were I in his shoes (supposing things happened as he said) I would have immediately gone to the kids’ mother and told her that her daughter has a problem, seek help.
No, this “man” is a child molester, this 12 year old did NOT “come on to” him (except in his twisted mind) and he deserves everything coming his way in prison.

A 38-year old man who has no self control needs to be removed from this world as soon as possible. “If it feels good do it” is a phrase from Satan himself.
Any photos of this “child”? Did the mother allow the girl to doll herself up like a ho-bag? I am still stunned by what I saw at my kids (former) middle school. 11-12-year old girls who are 5’ 7”, fully developed and wearing tons of makeup, tatoos, etc. Almost all of them were black. There was a study showing that puberty among black girls is 18-24 months earlier than whites. The study hinted that earlier exposure to sexual activity triggers early onset of puberty. I have no idea if that is true. Not sure what the race is in this case, or what the girl looked like. It stuns me how some parents let their daughters (and sons) dress these days.

He's probably never heard of him. His qualification is that he's from Spotsylvania County Virgina. They still have a molester/murderer on the loose for about the last 10 years. Maybe this is him.

Concur. I really believe that any man guilty of sex with a minor should be castrated if sentenced to prison terms as they are only going to try it again when they get out.
This guy’s real mistake was not becoming a famous director after doing this. Maybe they should let the guy try making a movie before the trial? If he makes a good movie, they should leave him alone. At the very least, it needs to be determined whether or not this was rape-rape./s

I'm with you on that. It's mind boggling how these little kids dress. Even if she did come on to him, the correct response should have been to drag her into her mama and have mama give her a good spanking....... oops, can't have spankings now days so it's best to let them act like sluts.
While that was the case in the past, today they don't care. Today's prisoners are all about what gang you side with, not what you did on the outside.

No doubt that girls of that age are going to experiment with their “wiles” but it stretches credulity that it would be on an adult male who is 38 years old. I would be more understanding if he was 18, maybe 20 years old max.
Let him sit in jail for 15 years and think about his decision.

I am in no way condoning what this guy did. But I have a friend who teaches this age group. He said the girls are very aggressive and flirty for their age. Some of his stories would make your jaw drop. Just another reason why we homeschool.
I have a VERY hard time believing that to be true. While early onset of puberty may trigger earlier sexual activity, I see no way the opposite can happen.
I say that as the mother of an 11 year old daughter who has physically developed far earlier than I did. I have girls ranging in age from 6-14 in and out of my house on a regular basis, and some of those girls have bodies that many 18 years olds would die for. Heck, I'm 49 and I never had a body like some of them have. SIGH :(
The sad thing is, they are still little girls, but because of how they look they are not taken for what they really are.
They still love to play dress up, and my stash of cocktail dresses and evening gowns are among their favorites (another mom, with a similar collection is another fave.) It's fun for them because they are still little girls and want to play princess. They also know that they can have their fashion shows and put on makeup, but they do it in the house and all makeup is removed before they get ready to leave or even go outside to play.
I don't know why these girls are developing so early, but it is up to the parents to teach them what they need to know, but also to remember that regardless of what they look like, they are still children and need to be treated and protected as such.
Marriage is no guarantee that a second husband won’t molest your daughter but it is not a guarantee that your daughter will not be molested by her own father either.
I have no source other than my own experience, but I believe that marriage would indicate more commitment to the relationship and therefore to the standards of behavior inherent in marriage.
A man that is not willing to marry you or is opposed to marriage period is more likely to lack the morals that would prevent his molesting your daughter.
So where was DAD? A trial and prison would be the LEAST of this guy’s worries if this were my daughter!
Well, I've taught this age group and I found most girls to be very shy. However, I will admit that I cannot understand why their moms allow some of them to come to school dressed as they are. A lot of my students already had ears pierced (some with other body parts pierced--nose, eyebrows, etc.). And the mode of dress that some wore can only be described as "slutty redneck" (i.e. skin-tight jeans, blouses that expose part of stomach area and others too low cut). But that's today's public school system for you.

NO excuse for him though. Just that I was shocked when my daughter was in middle school to see what the 12-year-olds were wearing, and how they would talk about having sex with older men and getting pregnant, and how good that would be for them. Several were in fact pregnant.
Most of this seemed to be among the hispanic population, although blacks were involved as well. I didn’t see it as much among the white population, a lot of whom did not live in the school district but were brought in by bus for specialty programs aimed at raising the schools overall acheivement levels.
A mother has to be extremely careful when allowing a male into her house on a regular basis.

There was a case a few years back where a man made the same claim about a two year old child - that she had “come on to him”. I think she died from the rape.
The story didn’t mention it, but you also have to wonder if the girl simply didn’t like the guy being with her mother, and wanted to get rid of him.
I’m pretty sure there’s been a movie with that type of plot.

Studies have shown (I know, those words ...) that exposure to sexually-explicit media and sexual behavior is *one* factor in *some* instances of earlier onset of puberty. There's also a correlation with the residence of non-family-member males in the household (e.g., Mom's latest sex partner). There was some discussion of a hormonal mechanism; that is, actual causation rather than simply correlation.
The book that detailed all this, with footnotes, is called "Early Puberty," iirc, and it also observed that *weight* is the major factor in the lower average age of puberty.
The latest theory I have read to explain the earlier onset of puberty are;
Better nutrition and less exercise.
A higher percentage of body fat in young girls leads to an earlier onset of puberty. Less exercise by today’s girls leads to the girls carrying extra body fat. Estrogen is fat soluble which means that the girl bodies retain more estrogen than they would if they carried less fat.
Athletic girls (such as swimmers and gymnast) tend to enter puberty later. This is attributed to their lower body fat.

But I told my sister boys and girls (we had one each) alike these days wear thing on street I would not let mine sleep in....its scary. Parent need to be parent not friends to there kids...ie teach them right from wrong the what NO means. Kids are running the home now not parents. God help us all.....I feel for the good parent today.
This woman has zero self-esteem and has had two marriages/divorces in her life. She blames herself for the incident and contemplates suicide daily, hoping she will die in her sleep.
